<br />ORDINANCE <br /> <br />It <br /> <br />, 1998 <br /> <br />~ <br /> <br />AN ORDINANCE AMENDING ORDINANCE 2, 1994 <br />"AN ORDINANCE ESTABLISHING CONTRIBUTION <br />REQUIREMENTS FOR DEVELOPERS AND NEW USERS <br />OF THE TOWN OF MOORESVILLE SEWER SYSTEM" <br /> <br />WHEREAS, the Town of Mooresville, Indiana operates a municipal <br /> <br />sewer system for the collection and disposition of sewage from <br /> <br />property in and about the Town and desires to extend such service <br /> <br />from time to time; <br /> <br />WHEREAS, the Town established a contribution requirement for <br /> <br />developers and new users of the Town of Mooresville's sewer system <br /> <br />in is Ordinance 2, 1994; <br /> <br />WHEREAS, it has become necessary to amend this Ordinance to <br /> <br />more effectively address the issues of the manner of payment of the <br /> <br />connection and availability cost; <br /> <br />NOW, THEREFORE, BE IT ORDAINED, by the Town Council of the <br /> <br />civil Town of Mooresville, Indiana: <br /> <br />1. That section III of Ordinance 2, 1994 be amended to read <br /> <br />as follows: <br /> <br />SECTION III - MANNER OF PAYMENT <br /> <br />Payment of the Availability and Connections Costs shall be made at <br /> <br />the following times and in the following manner: <br /> <br />A. Availabilitv Costs. The first half of the Availability Cost <br />shall be paid at the time of the issuance of the Plan or Planned <br /> <br />unit Development approved by the Mooresville Plan Commission, <br /> <br />approving the Plat for recording purposes. <br /> <br />In the event the <br /> <br />property is being platted in sections, the installment shall be due <br /> <br />on the respective sections as they are platted.
