<br />-- <br /> <br />property is not part of a Plat or Planned Unit Development then <br />one-half (1/2) shall be due and paid upon completion of the <br />construction of the proposed sewer improvements and the acceptance <br />by the Town of Mooresville which shall occur prior to the issuance <br />of any building permit on structures served by the line. This <br />initial payment shall be based upon a minimum of one-tenth (1/10) <br />of an EDU per 1,000 square feet. The balance of the Availability <br />Cost shall be paid at the time of occupancy based upon actual EDU <br />calculations determined by the Town at that time based upon the <br />Town's determination of the applicable use under Attachment No.1. <br />In the event the use changes during the first year of the occupancy <br />to a greater number of EDUs then the additional monies shall be due <br />immediately upon the change of use. This change of use factor <br />shall be applicable only for the initial year from the date of <br />first occupancy, <br />B. Connection Costs. Connection costs shall be due and payable <br />upon application for connection to the Town Sanitary Sewer System. <br />In the event the use changes within the first year from the date of <br />occupancy to a greater number of EDUs then additional fees shall be <br />due and owing immediately upon the change of occupancy within that <br />one (1) year period. Upon a showing to the Town Council of some <br />undue hardship and public need or enhancement by the connection the <br />Town Council shall have the discretion to waive the connection <br />fees. <br /> <br />2. All other sections not specifically amended shall remain <br />the same and unaffected by this Amendment. <br />3. This Amendment was passed at the meeting of May 4, 1998 <br />
