ORDINANCE VACATING A PART OF AN ALLEYWAY IN THE CIVIL TOWN OF MOORESVILLE, INDIANA /:./.~)....(k-ê./ N-(~/J 7,. ?/-J'7 ~' The Town Board of Trustees of the Civil Town of Mooresville now find the following: 1. That a petition to vacate a part of the right-of-way of the alley running south of and parallel to South Street and east of South Indiana Street, in the Civil Town of Mooresville, being filed by Horace E. Adams and Marian E. Adams was filed October 17, 1986 and brought before the Town Board at its meeting November 18, 1986. That pursuant to Indiana Code 36-7-3-12 and 5-3-1 the proper notices \I'ere given. 2. That in particular the following described real property was requested to be vacated due to the fact that said property was not being used as a public right-of-way but instead was being used as a part of the residence at said location, the legal description being: Twenty (20) foot alley south of and adjacent to Block 63 and Block 62 in Moore's Fourth Addition to the Town of Mooresville, Morgan County, Indiana, as follows, to-wit: Beginning at the Southeast corner of Lot No.2, Block 64 in Moore's Fourth Addition to the Town of Mooresville, run thence easterly on the North line of said 20 foot alley to the Southeast corner of Lot No.1, Block 62 in Moore's Fourth Addition; run thence southerly a distance of 20.0 feet to the South line of said alley; run thence westerly on the South line of said alley a distance of 340.0 feet to a point 20.0 feet south of the Southeast corner of Lot No.2, Block 64 in said addition; run thence northerly a distance of 20.0 feet to the place of beginning, containing 6800 square feet (0.156 of an acre), more or less. 3. That the area covered by this petition and described herein is shown on the attached Exhibit "A" as an alley directly behind the property of Horace E. Adams and Marian E. Adams and Sylvia M. Gregory. 4. That the Town finds that the use of said property as ingress and egress has not occurred in excess of thirty (30) years and said property is in no condition to, be cleared and graded to use as said access. 5. That the Town of Mooresville finds it in the best interest of the Civil Town of Mooresville to vacate said real property. NOW, THEREFORE, be it ordained by the Town Board of Trustees of the Civil Town of Mooresville, Indiana that the following described real property which is a public right-of-way now be vacated and divided as follows:
