<br />r <br /> <br />. <br /> <br />ORDINANCE NO. ¡ I ,1984 <br />AN ORDINANCE REGULATING REMOVAL OF WEEDS AND RN,K VEGETATION <br /> <br />BE IT ORDAINED, by the Board of Trustees of the Civil Town of Mooresville, <br /> <br />Indiana, by the acts of the General Assembly of the State of Indiana, it is <br /> <br />hereby ordered and ordained that <br /> <br />WHEREAS, it is necessary to establish reasonable regulations for the <br /> <br />protection of the lives, health and property of the citizens of the Civil Town <br /> <br />of Mooresville and to enforce compliance with such regulations; <br /> <br />IT IS HEREBY ORDERED AND ORDAINED that an ordinance be adopted concerning <br /> <br />the removal of weeds and rank vegetation. <br /> <br />Section 1. Be it hereby ordered that Indiana Code 36-7-10-3 which is as <br /> <br />follows: <br /> <br />" Sec. 3. (a) This section applies to the following units: <br /> <br />(1) Counties and cities that adopt this section by ordinance. <br /> <br />(2) Towns <br /> <br />(b) The legislative body of a municipality, or the executive of a <br />county, may require the owners of real property in the unit to cut <br />and remove weeds or other rank vegetation growing on that property. <br />A five (5) day written notice to remove the vegetation must be issued <br />by the fiscal officer of the unit and served by a law enforcement officer <br />of the unit upon the landowner, if he is a resident, or by registered <br />mail addressed to his last known address, if he is a nonresident. <br /> <br />(c) If the landowner fails to remove the vegetation within the time <br />prescribed, the unit may remove the vegetation. The fiscal officer of <br />the unit must make a certified statement of the actual cost incurred <br />by the unit in the removal. The statement must be delivered to the <br />owner of the property by a law enforcement officer of the unit, or by <br />registered mail, and the owner shall pay the amount to the fiscal officer. <br />If the landowner fails to pay the amount within ten (10) days <br />after receiving the statement, a certified copy of the statement of <br />costs shall be filed in the office of the auditor of the county in which <br />the property is located. The auditor shall place the amount claimed <br />on the tax duplicate against the property affected by the work, and <br />the amount shall be collected as taxes are collected and shall be <br />disbursed to the general fund of the unit." <br /> <br />is hereby adopted as the law of the Civil Town of Mooresville. <br /> <br />Section 2. That any brush, weeds, vegetation of any type which constitutes <br /> <br />an unsightly, offensive, or unsanitary condition within the Civil Town of Mooresville <br /> <br />shall be removed as set out herein. That all property shall be maintained in a <br /> <br />state of reasonable care with no vegetation or growth creating an unsightly òr <br /> <br />offensive or unsanitary condition. <br /> <br />Section 3. The Town Building Inspector shall be the enforcement agent <br /> <br />for this ordinance and responsible for sending notice through his office or the <br /> <br />office of the Town Attorney for violations. <br />
