r. then file for the necessary permit the next business day that the Clerk-Treasurer's office is open and comply with all other terms of this ordinance at such time. In the event that the applicant does not file for the necessary permits on the next business day of the Clerk-Treasurer's office it will be considered as a violation and violator will be subject to the penalty provisions set out in this ordinance. Section 6 (a) Responsibility for Maintenance, It shall be the responsibility of the permit holder to maintain all cuts made within the roadway surface until the Mooresvil1e Street Department resurfaces or reconstructs the roadway. There shall be no time limit on this responsibility, (b) There shall be no permits issued under this ordinance affecting any street or roadway which has been resurfaced within two years from the date of said permit application. This section shall not apply in the case of an emergency which threatens the public safety or damage to property. Section 7 Completion Notice. All permit holders shall notify the Town of Mooresville through its Clerk-Treasuer's Office, in writing upon completion of the work encompassed by the permit. The letter shall be signed by the permit holder and sent to the following address: Civil Town of Mooresville, Clerk-Treasurer's Office, 26 South Indiana Street, Mooresville, Indiana 46158. Section 8 It shall be the responsibility of the permit applicant to mark all excavations and fence the same off if necessary for safety purposes. In addition applicant shall be responsible for the protection and well-being of the general public from any excavations or construction or reconstruction being done and shall properly police the same from the general public along with providing all necessary safety markers, barricades and lighting to provide for the safety of all forms of traffic. ì , I I , i ì I I I I , I i , I I I í I I l Section 9 Before any such intended work is started, the applicant shall pay to the Clerk of the Civil Town of Mooresville, a permit fee of Twenty-Five Dollars ($25.00) per first fifty (SO) square foot of the cut and an additional One Dollar ($1.00) for each square foot of cut thereafter. In addition there shall be an inspection fee in the amount of Twenty-Five Dollars ($25.00) per street cut.
