<br />I <br /> <br />Section 10 <br /> <br />(a) Violation Assessment Schedule. If a permit is not obtained and this <br /> <br />fact is discovered while the job is in progress, a fine of Ten Dollars ($10.00) <br /> <br />per square foot of disturbed surface, with a minimum of Thirty Dollars ($30.00) <br /> <br />shall be assessed. A permit is still required and its cost shall be in addition <br /> <br />to the fine. The job shall be closed down until the required permit is obtained. <br /> <br />(b) Any person, firm or corporation violating any other provisions of this <br /> <br />ordinance shall be fined not less than Twenty-Five Dollars ($25.00), nor more <br /> <br />than One Hundred Dollars ($100.00), for each offense, and a separate offense <br /> <br />shall be deemed committed on each day during, or on which a violation occurs <br /> <br />or continues. <br /> <br />PART II <br /> <br />BE IT FURTHER ORDAINED by the Board of Trustees of the Civil Town of <br /> <br />Mooresville, Morgan County, State of Indiana, that: <br /> <br />Section 1 <br /> <br />Each public and/or private utility doing business within the corporate <br /> <br />limits of the Civil Town of Mooresville, Morgan County, Indiana, shall file <br /> <br />with the Clerk-Treasurer of the Civil Town of Mooresville, Indiana a corporate <br /> <br />surety bond in the principal sum of Ten Thousand Dollars ($10,000.00), as and <br /> <br />for assurance to the Board of Trustees of the Civil Town of Mooresville, Indiana, <br /> <br />that each of such utilities shall fully comply with the provisions of Part I of <br /> <br />this Ordinance, regulating the maintenance, repair, cutting, construction, <br /> <br />reconstruction or alteration of public streets, alleys, curbs, sidewalks and <br /> <br />other publicways within the Civil Town of Mooresville, Indiana. <br /> <br />Section 2 <br /> <br />In the event that any such utility shall-fail to comply with the provisions <br /> <br />of the above section of Part II of this Ordinance, permits as are provided <br /> <br />for in Part I of this ordinance shall not be issued until compliance is had, <br /> <br />Section 3 <br /> <br />Any person, business, corporation or other entity, other than public or <br /> <br />private utilities, which shall make application for a permit to cut, construct, <br /> <br />reconstruct or lay any pavement on any public street, alley, curb, sidewalk <br /> <br />or other publicway, or to repair the same, or alter the same, shall be obligated <br /> <br />to make application and to pay the stated permit fee as set out in Section 9 of <br /> <br />Part I of this ordinance and the inspection fee of Twenty-Five Dollars ($25.00) <br />
