The cash bond shall be retained by the Board of Trustees of the Civil <br /> <br />Town of Mooresville, Indiana, until completion of the project by applicant. <br /> <br />The permit applicant shall replace, and at all times keep, and leave the <br /> <br />involved publicway, public street, public alley, curb or sidewalk or part of <br /> <br />the same, in as good repair as it was before the permit was issued. After the <br /> <br />completion of the project by applicant, but before any of the deposit shall be <br /> <br />returned and refunded to the permit applicant, the Town shall deduct from said <br /> <br />deposit, any amount which is necessary to compensate said town or any of its <br /> <br />employees or agents, for replacing the involved publicway, public street, public <br /> <br />ally, curb or sidewalk, or part thereof, in as good repair as the same was <br /> <br />before the permit was issued and the work completed by the permit applicant. <br /> <br />The balance of said deposit, if any, shall thereafter be refunded to the permit <br /> <br />applicant. <br /> <br />Section 7 <br /> <br />Waivers. Upon written application by a person or entity subject to the <br /> <br />provisions of this ordinance, the Town Board of Turstees of the Civil Town of <br /> <br />Mooresville, may. if they determine that such action is consistent with the <br /> <br />public safety and interest, grant a waiver of any requirement set out in this <br /> <br />ordinance on projects or projects to be performed by that person requesting <br /> <br />said waiver. All waivers so granted shall be in writing and remain in effect <br /> <br />unless and until revoked in accordance with this ordinance.
