<br />r <br /> <br />for the safe, economical and efficient management of the Town's <br /> <br /> <br />sewage treatment works, and for the regulation, collection, rebating <br /> <br /> <br />and refunding of eny such sewer rate charges, <br /> <br /> <br />SECTION IX: The Board of Trustees of the Town of Mooresville <br /> <br /> <br />is hereby authorized to prohibit dumping of sanitary sewage and <br /> <br /> <br />industriAl waste into the Town's sanitary se',¡age works, which in its <br /> <br /> <br />discretion is deemed harmful to the operation of the sewage treatment <br /> <br /> <br />works system of said Town, or it shall have the power to require <br /> <br /> <br />effective pretreatment methods of such waste to reduce the <br /> <br /> <br />characteristics of the waste passing through the sewage treatment <br /> <br /> <br />works of the Town which pretreatment is satisfactory to the Board <br /> <br /> <br />of Trustees, <br /> <br /> <br />SECTION X, In the event any owner or other user of the Town <br /> <br /> <br />sewage treatment works shall permit the dumping of waste and/or <br /> <br /> <br />sewage into the Town's sewage works, which are harmful to the <br /> <br /> <br />operation of the system, then the owner or user shall be required <br /> <br /> <br />to pay for the damages plus a penalty of not less than One Hundred <br /> <br /> <br />Dollars ($IOO,OO) per day for each day in which such dumping occurs, <br /> <br /> <br />Such damages shall be not less than the actual costs to the Town of <br /> <br /> <br />Mooresville of Jocating the source of dumping and repairing any damage <br /> <br /> <br />to the sewage treatment works, caused by such dumping, <br /> <br /> <br />SECTION XI: In order that the rates and charges for sewage <br /> <br /> <br />services may remain fair and equitable and be in proportion to the <br /> <br /> <br />cost of providing services to the various user or user classes, the <br /> <br /> <br />Town of Mooresville shall cause a study to be made within a reasonable <br /> <br /> <br />period of time, Such study shall include, but not be limited to, an <br /> <br /> <br />analysis of the costs associated '!lith the treatment of excessive <br /> <br /> <br />strenght effluents from industrial users, volume and delivery flow <br /> <br /> <br />rate characteristics attributed to the various users or user classes <br /> <br /> <br />the financial position of the sewage ,,'orks and the adequacy of its <br /> <br /> <br />revenue to provide reasonable funds for operation and maintenance, <br /> <br /> <br />replacements, debt service requirements and capital improvement to the <br /> <br /> <br />waste treatment systems, <br /> <br /> <br />Thereafter, on an annual basis, ,,¡ithin a reasonable period <br /> <br /> <br />of time following the normal accounting period, the Town of Mooresville <br /> <br /> <br />shall cause a similar study to be made for the purpose of reviewing <br /> <br /> <br />the f""irness and equity of the rates and charges for sewage services <br /> <br />-8- <br />
