<br />1 <br /> <br />ORDINANCE NO, 2, 1981 <br /> <br />AN ORDINANCE OF THE BOARD OF TRUSTEES OF THE TOWN OF MOOr~SVILLE, <br />INDIANA AMENDING ORDINANCE NUMBER I, 1972, WHICH ORDINANCE WAS <br />ENTITLED "ZONING REGULATIONS OF 1100RESVILLE, INDIANA - 1972" AND <br />AS THE SA}Œ HAS BEEN AMENDED FROM TIME TO TIME SINCE PASSAGE N,D <br />PARTICULARLY WITH REFERENCE TO ORDINANCE NUMBER 20, 1979, WHICH <br />AMENDMENT vJAS ENTITLED "ORDINANCE AMENDING ZONING REGULATIONS OF <br />THE CIVIL TOWN OF MOORESVILLE, INDIANA, PROVIDING A MASTER pnAN <br />FOR THE DEVELOPMENT OF CONTIGUOUS UNINCORPORATED AREAS OlITSIL':':: OF <br />THE LIMITS OF THE TOWN OF MOORESVILLE, INDIANA", <br /> <br />WHEREAS, the Board of Trustees of the Civil Town of <br /> <br />Mooresville, State of Indiana, propose to the Mooresville Plan <br /> <br />Commission that the zoning regulations of the Town of Mooresville <br /> <br />be supplemented to include an ordinance entitled "Adult Entertain- <br /> <br />ment Activities - Special Restrictions"; and <br /> <br />WHEREAS, said proposed supplement or amendment to the <br /> <br />Mooresville Zoning Regulations, Ordinance I, 1972 and all amendments <br /> <br />thereto, was transmitted to the Mooresville Plan Commission for <br /> <br />consideration, report and recommendation pursuant to statute; and <br /> <br />v~EREAS, the Mooresville Plan Commission scheduled a <br /> <br />public hearing on the proposed amendment to the "Zoning Regulations <br /> <br />of Mooresville, Indiana - 1972" as the same have been amended from <br /> <br />time to time and specifically by said Ordinance No, 20, 1979; and <br /> <br /> <br />WHEREAS, a public hearing before the Mooresville Plan <br /> <br />Commission was conducted and all citizens of the Town of Mooresville <br /> <br />so desiring had an opportunity to be, and were in fact heard; and <br /> <br />WHEREAS, it has been acknowledged and recognized by the <br />Board of Trustees of the Civil Town of Mooresville, Indiana that <br /> <br />adult bookstores and adult motion pictures theatres have an <br /> <br />adverse effect upon adjacent areas and districts when such <br /> <br />adult entertainment establishments are concentrated in a particular <br /> <br />area; and <br /> <br />WHEREAS, special regulation of adult bookstores and <br /> <br />adult motion picture theatres is necessary to insure and guarantee <br /> <br /> <br />that such adverse effects will not contribute to blighting or down- <br /> <br />grading of the surrounding neighborhood and community; and <br />
