<br />I <br /> <br />, <br /> <br />WHEREAS, the Board of Trustees of the Town of Mooresville, <br /> <br /> <br />Indiana deem it wise and expedient to establish distance require- <br /> <br /> <br />ments for adult bookstores and adult motion picture theatres in order <br /> <br /> <br />to prevent a concentration of such uses in a particular area, <br /> <br /> <br />NOW, THEREFORE, BE IT ORDAINED by the Board of Trustees <br /> <br /> <br />of the Town of Mooresville, Indiana as follows: <br /> <br /> <br />Section I, Findings, Declarations of Public Policy <br /> <br /> <br />and Purpose. <br /> <br /> <br />A, Findings. The Board of Trustees of the Town of <br /> <br /> <br />Mooresville, Indiana, finds as follows: <br /> <br /> <br />I, That the prohibition against the establishment <br /> <br /> <br />of regulated adult activities within five Hundred (500) feet of <br /> <br /> <br />each other serves to avoid the clustering of such activities <br /> <br /> <br />which, when located in close proximity to each other, tends to <br /> <br /> <br />create a "Skid Row" atmosphere. <br /> <br /> <br />2, That the prohibition against the establishment <br /> <br /> <br />of adult entertainment activities within five hundred (500) feet <br /> <br /> <br />of areas zoned for residential use, schools, parks, recreational <br /> <br /> <br />areas, churches and other public places is a necessary and proper <br /> <br /> <br />exercise of the Town's police and zoning powers in order to protect <br /> <br /> <br />and enhance the safety, health and general welfare of the citizens <br /> <br /> <br />of Mooresville, Indiana and all contiguous areas in which the Town <br /> <br /> <br />regulates zoning, <br /> <br /> <br />B, Declaration of Public Policy, The Board of Trustees <br /> <br /> <br />of the Town of Mooresville, Indiana hereby declares as a matter of <br /> <br /> <br />public policy that the regulating of the location of adult enter- <br /> <br /> <br />tainment activities is a public necessity and is required in the <br /> <br /> <br />interest of the health, safety, welfare and economic and aesthetic <br /> <br /> <br />well being of the citizens of 1100resville and its contiguous areas, <br /> <br /> <br />c. Pupose, The purpose of this ordinance is to effect <br /> <br /> <br />the declaration of public policy set forth herein as it relates to <br /> <br /> <br />the foregoing findings of the Board of Trustees of the Town of <br /> <br /> <br />Mooresville, and more particularly: <br /> <br /> <br />1, To protect property values; <br /> <br /> <br />2, To promote harmonious use of neighboring properties <br /> <br /> <br />to their mutual benefit; <br /> <br />-2- <br />
