<br />are delineated on the Flood Boundary and Floodway Maps which <br /> <br />along with the Flood Insurance Rate Maps and Flood Insurance <br /> <br />Study text are hereby adopted by reference and declared to be <br /> <br />a part of this Ordinance. The Flood Insurance Study is on <br /> <br />file with the Clerk-Treasurer of the Town of Mooresville, <br /> <br />Indiana. <br /> <br />Section 3. Penalties and Remedies: <br /> <br />A. Penalties: Any person, firm, associa- <br /> <br />tion or corporation, who should violate any of the provisions <br /> <br />of this Ordinance or fail to comply therewith or with any of <br /> <br />the requirements thereof or who shall build, reconstruct or <br /> <br />structurally alter any building in violation of any of the <br /> <br />terms hereof, shall, for each and every violation or non- <br /> <br />compliance, be guilty of a Class C. Misdemeanor. <br /> <br />B. Remedies: The Mooresville Plan Com- <br /> <br />mission, the Mooresville Board of Zoning Appeals, the Town <br /> <br />of Mooresville's Building Inspector, or any designated en- <br /> <br />forcement official, or any person or persons, firm or cor- <br /> <br />poration, jointly and severally aggrieved, may institute a <br /> <br />suit for injunction in the Circuit Court of Morgan County to <br /> <br />restrain an individual or a government unit from violating <br /> <br />the provisions of this Ordinance. The Mooresville Plan Com- <br /> <br />mission or the Mooresville Board of Zoning Appeals may also <br /> <br />institute a suit for mandatory injunction directing an indi- <br /> <br />vidual, corporation or a governmental unit to remove a struc- <br /> <br />ture erected in violation of the provisions of this Ordinance. <br /> <br />Any building erected, raised, or converted, or land, or pre- <br /> <br />mises used in violation of the provisions of this Ordinance or <br /> <br />the requirements thereof, is hereby declared to be a common <br /> <br />nuisance and as such may be abated in such a manner as nui- <br /> <br />sances are now or may hereafter be abated under existing law. <br /> <br />Section 4. Abrogation and greater restrictions: <br /> <br />This Ordinance is not intended to repeal, abrogate, or impair <br /> <br />any existing easements, covenants, or deed restrictions.
