<br />ORDINANCE NO. 13, 1982

<br />AN ORDINANCE REGULATING BURNING OF GARBAGE, OR OTHER ORGANIC REFUSE IN THE
<br />TOWN OF MOORESVILLE, INDIANA AND ESTABLISHING THAT ALL INCINERATORS OF
<br />BUSINESSES WITHIN THE TOWN OF MOORESVILLE, INDIANA SHALL INSTALL
<br />SCREENS OVER AND ACROSS SUCH INCINERATORS TO CONTROL THE EMISSION
<br />OF FLAMMABLE MATERIAL THEREFROM
<br />
<br />BE IT ORDAINED by the Board of Trustees of the Town of Mooresville,
<br />
<br />Indiana, that:
<br />

<br /> By the powers vested in said Board of Trustees of the Town of Mooresvil1e,
<br />Indiana by the laws of the State of Indiana and all amendments thereto, it is
<br />hereby ordered and ordained that whereas it is necessary to regulate and prohibit
<br />
<br />the introduction of substances or odors into the air which endanger the public
<br />
<br />health, safety and welfare of the citizens of the Town of Mooresville, Indiana,
<br />
<br />that an ordinance be adopted establishing and regulating the hours in which any
<br />
<br />garbage or refuse shall be burned in the Town of Mooresville, Indiana and
<br />
<br />establishing that all incinerators being operated by businesses in the Town
<br />
<br />of Mooresville, Indiana shall cover said incinerators with proper screening
<br />
<br />to control the emission of flammable material therefrom.
<br />
<br />NOW THEREFORE, BE IT ORDAINED, by the Town Board of Mooresville, Indiana:
<br />
<br />Section I:
<br />
<br />Definitions. The following definitions shall apply in the interpretation
<br />
<br />of enforcement of this ordinance:
<br />
<br />(1) "Person" shall mean any person, firm, partnership, association,
<br />
<br />corporation, company or organization of any kind.
<br />
<br />(2) "Garbage" shall mean waste resulting from the handling, preparation,
<br />
<br />cooking and consumption of food; waste from the handling, storage and sale of
<br />
<br />produce; including all waste, all accumulation of animal, fruit or vegetable
<br />
<br />matter, meat, fish or fowl.
<br />
<br />(3) "Refuse" shall mean combustible trash, including but not limited to
<br />
<br />paper, cartons, boxes, barrels, woods, excelsior, furniture, bedding; non-
<br />
<br />combustible trash, including but not limited to metals, tin cans, metal furniture,
<br />
<br />dirt, small quantities of rack and pieces of concrete, glass, crockery, other
<br />
<br />mineral wastes; street rubbish including but not limited to, street sweepings,
<br />
<br />dirt, catch-basin dirt, contents of litter receptables excluding IIgarbage".
<br />
<br />(4) "Yard Rubbish" shall include all trimmings from plants and shrubs and
<br />
<br />all plants and shrubs dug up and discarded with the intention of removing the
<br />
<br />same from a yard or tree branches or yard trimmings and leaves.
