<br />... <br /> <br />SECTION II: <br /> <br />IT IS FURTHER PROVIDED AND ORDAINED that the Town Marshall <br /> <br />or any person designated by the Board of Trustees of the Town of <br /> <br />Mooresville, Indiana, shall post or cause to be posted, suitable signs <br /> <br />,~ <br /> <br />on the aforesaid Harlan Drive designating such weight limitation. <br /> <br />SECTION III: <br /> <br />IT IS FURTHER PROVIDED AND ORDAINED that any peace officer <br /> <br />for the Town of Mooresville, Indiana, having reason to believe that <br /> <br />a motor vehicle is using said Harlan Drive in violation of this ordi- <br /> <br />nance, and that the load thereon is unlawful, is authorized to stop, <br /> <br />! <br /> <br />measure and weigh the same by means of portable or stationary scales <br /> <br />., <br />I <br />;1 <br /> <br />and is authorized to direct that such motor vehicle shall be driven <br /> <br />to the nearest stationary scales in the event such scales are within <br /> <br />two (2) miles, and if such peace officer finds that such vehicle is <br />" <br /> <br />~" <br /> <br />loaded in violation of the provisions of this ordinance, shall have <br /> <br />the right at that time, and place, to cause the excess loan to be <br /> <br />removed from said motor vehicle; and all material and goods so re- <br /> <br />moved shall be removed and cared for at the risk of the owner and/or , <br /> <br />operator of such motor vehicle. <br /> <br />SECTION IV: <br /> <br />A violation of this ordinance is hereby declared to be <br /> <br />a misdemeanor punishable by a fine of not less than One Dollar ($1.00) <br /> <br />nor more than Twenty-five Dollars ($25.00) for each offense; provided <br /> <br />that each violation of this ordinance shall constitute a separate <br /> <br />offense. <br /> <br />Whereas an emergency exists, this ordinance is declared <br /> <br />to be in full force and effect on passage of the same, and the Clerk- <br /> <br />Treasurer is directed to publish said ordinance for two (2) consecu- <br /> <br />tive weeks. <br /> <br />-2- <br /> <br />, <br />
