1.21.1. <br />Septemberl, 2015 <br />The Mooresville Town Council met in regularsession on Tuesday, September 1, 2015 at 6:30 P. M. at the <br />Mooresville Government Center. <br />Town Council members present were: Mark Mathis, Virginia Perry, Tony Langley, Joe Beikman, and Jeff <br />Cook. No members were absent. Town Attorney Tim Currens was also present. <br />Council President Mark Mathis gave the prayer. <br />A motion was made by Councilman Langley with a second by Councilman Beikman to approve the <br />minutes from the previous meeting. Motion carried 4 -0 -1. Mark Mathis abstained. <br />A motion was made by Councilman Langley with a second by Councilwoman Perry to approve payment <br />of the claims in the amount of $506,669.86. Motion carried 5 -0. <br />A motion was made by Councilman Beikman with a second by Councilmen Cook to award the paving bid <br />from Wallace in the amount of $232,011.00. Motion carried 5 -0. <br />Highway 267 relinquishment tabled to next meeting. <br />Annexations: Attorney Currens had received a petition for all three (Economy Htg, Rick Jones, and <br />Valley Motors and he will proceed with the financial plan. Rick Remster annexation will be the 2nd <br />meeting in October and will proceed with the others. <br />Councilwoman Perry read the following statements concerning Resolution 5, 2015 from the <br />Redevelopment Commission: <br />September 12015 <br />Resolution #5 - 2015' <br />The Indiana Street /Ditch Committee received information that funds were being made <br />available to them for their project and should include the recent flooding from July of this year <br />The Committee has worked for two years to obtain funding to secure a Preliminary Engineer <br />Report to submit to various funding opportunities, including the MPO. The Committee met and <br />Agreed to include the recent flooding issues experience by many in July of this year. Among <br />those present was a representative from Banning Engineering who was selected by the <br />Committee to go forward with a quote for the PER report. That report was due to be presented <br />at our next meeting <br />In our packet for this evenings meeting is Resolution #5 from the Redevelopment Commission <br />signed by Harold Gutzwiller. In that document there is no mention of the Indiana Street /Ditch <br />Project being part of that funding. The Committee believes they were misled when they were <br />told the funds would include their project. We have been told there was "intent ". I have never <br />signed a contract In my life based on intent. <br />Therefore, the Committee has notified the engineering firm that the Indiana Street /Ditch <br />project is not part of any PER and they have been provided a copy of the Resolution in question. <br />We also have notified the grant writer of the exclusion. <br />This is a move forward to those who suffered from the recent flooding and they should be <br />looking forward to a resolution soon to their flooding issues. The Resolution just does not, at <br />this time, include the much awaited Indiana Street /Ditch Project funding as promised. <br />
