Plan Commission <br />Minutes December 10th, 2015 <br />Members Present: Virginia Perry, Tammy VanHook, Perry King, Jeff <br />Dieterlen, Mike Young, Brian Anderson and attorney Tim Currens <br />Mike Young made an announcement that the parking lot / park at Indiana and <br />Main St was not on the agenda this evening. <br />Mike Young called for a motion on the previous meeting minutes, a motion <br />was made to approve, seconded and passed unanimously. <br />First item on the agenda is the continued rezone request at 135 Merriman Rd. <br />Mr. Bernard Lyons is asking for the rezone, he is in the process of purchasing <br />the property with the plans of constructing a pole barn to house his companies <br />excavating equipment. Mike Young asked if there were any questions; Ms. <br />Robinson from the audience asked how far the setbacks would be, Dennis <br />Nail explained that no building permit had been applied for yet, that would <br />come after the purchase and rezone but that he would have to meet current <br />building standards, she further asked what could be allowed under the <br />requested B3, Tim Currens let her review the zoning allowances. Joe <br />Campbell, also of the audience said he was ok with the current use proposed, <br />but has concerns what future B3 businesses could occur. Jeff Dieterlen <br />confirmed with attorney Tim Currens that they could approve / recommend <br />with a restriction. Mike Young called for additional questions and or a motion, <br />Jeff Dieterlen made a motion to recommend to the town council the rezone <br />with the restriction that it house excavating equipment only, the motion was <br />seconded and approved unanimously. <br />Second item is a minor plat, re plat at Pleiades Dr. and Deer Park Dr. for <br />TOA. The Plan Commission members asked Dennis Nail how the tech review <br />went, Dennis explained the plans meet all requirements and the wording of <br />two areas have been corrected as requested. The reasoning for the Minor Plat <br />is to take three existing parcels and make one parcel. Several members of the <br />audience came forward to look at the maps and to ask about property lines, <br />there was a brief pause while Dennis Nail of the building department and a <br />TOA representative from Banning Engineering answered questions. Once it <br />was clarified that no additional property was being added the meeting <br />continued. Audience members did come forward regarding the noise, <br />construction; big trucks, pounding equipment, windows rattling etc., Tim <br />Currens explained that if sound barriers had been removed and if noise <br />
