G. SPECIAL RESTRICTIONS <br /> <br />1. Any industrial operation or activity must, in addition to the above conform with the <br />Indiana Air Pollution Control Law and any applicable acts of the federal government. <br />Where the requirements of this ordinance are more restrictive, they shall take precedence. <br /> <br />2. A letter of approval from the Indiana Administration Building Council stating that <br />construction plans for a proposed building or structure to be used for industrial use meets <br />all required construction codes and safety codes of the State of Indiana shall be submitted <br />with the application for an improvement Location Permit. <br /> <br />H. VIOLATION <br /> Violation of this section shall result in any of the penalties set out under Chapter 11 <br /> "Remedies and Penalties of the Ordinance". All other legal remedies provided by law <br /> shall also be available to the Plan Commission and the Town of Mooresville. <br /> <br />SECTION 3.5 -MANUFACTURED HOMES <br /> <br />A. DEFINITIONS <br /> <br />For the purpose of this ordinance, the following definitions shall apply: <br /> <br />(1) '`Manufactured Home" means a dwelling unit, designed and built in a factory, <br /> which bears a seal certifying that it was built in compliance with the Federal <br /> Manufactured Housing Construction Safety Standards Law of 1974 (42 USC <br /> 5401 et seq.). <br />(2) "Underlying Floor Space" means that space between the bottom of the floor joist <br /> and the earth. <br />(3) "Occupied Space" means the total area of earth horizontally covered by the <br /> structure, excluding accessory structure such as, but not limited to, garages, <br /> patios and porches. <br />(4) "Mobile Home" means a transportable structure larger than three hundred twenty <br /> (320) square feet, designed to be used as a year-round residential dwelling. <br /> <br />B. INDIANA CODE PROVISIONS <br /> In accordance with the provisions of Indiana Code 36-7-4-1106, the establishment, <br />location, and use of "Manufactured Homes" as permanent residences shall be permitted <br />in any zone permitting installation of a dwelling unit, subject to requirements and <br />limitations applying generally to such residential use in the district and provided such <br />homes shall meet the following requirements and limitations; <br /> <br />(1) The homes shall meet all requirements applicable to single family dwellings and <br /> posses all necessary improvement location building and occupancy permits and <br /> other requirements of this ordinance that apply to single family dwelling <br /> structures. <br />(2) The homes shall contain more than eleven hundred (1100) sq. ft. ufoccupied <br /> space and be manufactured after January 1, 1981. The manufactured home will <br /> be attached to the ground with a tie down system as shown in the ''Manufactured <br /> <br />44. <br /> <br /> <br />
