C. ADVERTISING STRUCTURES <br />Advertising structures are permitted only in Industrial and B-3 districts, subject to the <br />restrictions of that district as established by this section, plus the following general <br />requirements that shall apply to all advertising structures: <br /> <br />1. No advertising structure shall be located closer than 1,000 feet in any direction fi.om <br /> any other advertising structure on the same side of the road, street or highway. <br /> <br />No advertising structure shall be located closer than 500 feet to any access ramp of a <br />limited access highway nor closer than 500 feet to the intersection of two or more <br />state highways. The distance to the access ramp shall be measured fi.om the point <br />where the pavement widening begins. <br /> <br />3. No advertising structure shall be placed within 500 feet of any dwelling or land <br /> platted and recorded for residential use, or any school, church, place of public <br /> assembly or park unless the property owner waives this requirement as it applies to <br /> his or her property. <br /> <br />An advertising structure may contain not more than two displays per facing, the <br />maximum combined area of which shall not exceed 128 square feet. No advertising <br />structure excluding supports and frames shall exceed 8 feet in height or 16 feet in <br />length. <br /> <br />The height of any advertising structure including supports and flame shall not exceed <br />40 feet measured from either the grade at its base or from the adjacent highway grade, <br />whichever is higher. A minimum of 5 feet of open space between the bottom of the <br />display and the finish grade is required. <br /> <br />6. Each advertising structure shall be set back at least 10 feet beyond the street or <br /> highway right-of-way, measured from the closest edge of the advertising structure. <br /> <br />No advertising structure shall be erected or maintained on or within an easement or <br />right-of-way, public or private, without special permission in writing from the person <br />entitled to grant such permission. <br /> <br />8. An Improvement Location Permit shall be required for the erection of an advertising <br /> structure. The application for the Improvement Location Permit shall include a plot <br /> plan certified by a registered Land Surveyor, showing the exact location of the <br /> proposed advertising structures, intersections, residences, etc. that are affected by the <br /> proposed structure and regulated by this section. The application for an Improvement <br /> Location Permit shall include a notarized statement to be submitted to the Morgan <br /> County Assessor showing the pally responsible for future tax assessments due on the <br /> advertising structure. <br /> <br />51. <br /> <br /> <br />
