All distances are measured from the perimeter of the <br />actively used area within the zone requiting the buffer to the property line of the zone <br />which needs to be protected. <br /> <br />"Actively used area" shall include all buildings, outside storage areas, outdoor utility <br />generation and transforming areas, driveways and other outdoor areas actively used for <br />the business or indust~. "Actively used area" shall not include lawns, other landscaped <br />areas or parking lots. <br /> <br />Section 3.10 EROSION CONTROL <br /> <br />The Developers, lot owners, and permit holders of any lot shall be responsible for <br />erosion control during any construction phase or development state of the lot. The <br />Developer, permit holder, and lot owner shall be each jointly and severally <br />responsible for keeping soil, construction and other erosion debris off of the streets of <br />Mooresville or to Morgan County. The Developer, permit holder, and lot owner shall <br />be each jointly and severally responsible for keeping soil and other construction <br />debris and other erosion debris out of storm sewers shown on the plat or storm sewers <br />which are owned by or dedicated to the Town of Mooresville or Morgan County. In <br />the event the Town of Mooresville or Morgan County is damaged by soil erosion on <br />their right of way, street, drainage easement, or in their storm sewer, they shall have <br />the option of having the debris removed and charge anyone or all of the following: <br />lot owner, builder or developer, for this expense. The Town of Mooresville or <br />Morgan County shall also have the option of giving the developer, permit holder, or <br />lot holder a written notice to have the debris removed within twenty-four hours.
