the event the debris is not removed within twenty-four hours. They shall be cited into <br />the Mooresville Town Court by a civil summons issued by the Town Building <br />Inspector as being in violation of this ordinance. In the event the Town of <br />Mooresville does remove the debris and passes the charge on to the lot owner, <br />builder, or Developer for the removal expense and the expense is not paid within <br />thirty days then they shall be cited in the Mooresville Town Court as being in <br />violation of this ordinance. Any Developer, owner, or permit holder found in <br />violation of this ordinance shall be fined in an amount of not less than $1.00 nor <br />greater than $500.00 for a violation of the ordinance along with being assessed all <br />costs for the clean up of the street or storm sewer and any additional damage created <br />by said violation shall be passed on to the violating party to hold harmless both the <br />Town of Mooresville and Morgan County for all damages created by the violation of <br />this ordinance. <br /> <br />(a) All developers shall be required to show the Plan Commission compliance with <br /> the State of Indiana's local erosion control commonly known as Rule 5 of 327 <br /> IAC 15, STORM WATER RUN-OFF associated with construction activity by <br /> showing copies of the plan filed with the State and certifying the date of the <br /> filing. This shall be done prior to final plat approval. <br /> <br />CHAPTER 4 - SPECIAL USES <br /> <br />SECTION 4.0 - SPECIAL USE PROCEDURE <br /> <br />The Special Uses listed in this chapter shall meet the following requirements of this <br />chapter as well as all other chapters of this ordinance. In a district in which the <br />specified use is allowed by right, the Building Inspector shall ascertain that the <br />specifications of this chapter are met. In a district in which the specified use is <br />allowed by Special Exception, the Board shall ascertain that the specifications of this <br />chapter are met prior to approval of the Special Exception. <br /> <br />SECTION 4.1 - SPECIAL USES - ALL DISTRICTS <br /> <br />These uses are permitted in any district but are subject to the requiremems of this <br />chapter: <br /> <br /> Artificial lake of 3 or more acres <br /> Mineral extraction <br /> Railroad right-of-way and necessary uses <br /> Sewage disposal plant (primary use) <br />Transmission lines for gas, oil, electricity and other utilities <br /> <br />SECTION 4.2 - MINIMUM LOT AREA - SPECIAL USES <br /> <br />A lot on which one of the following uses is located may not be smaller in area than <br />the area prescribed for that use on the following table. For uses not listed, the <br />requirements of the district in which the use is located shall apply. <br /> <br />58. <br /> <br /> <br />
