G. These provisions apply in the same manner to a use which may become a non- <br /> conforming use due to a later amendment to this ordinance. <br /> <br />H. A change of use must meet all applicable Town ordinances in addition to the <br /> requirements of this ordinance. <br /> <br />SECTION 8.1 - INCOMPATIBLITY OF NONCONFORMING USES <br /> <br /> Nonconforming uses are declared by this ordinance to be incompatible with <br />permitted uses in the districts in which such use is located. A nonconforming use of a <br />structure, a nonconforming use of land, or a nonconforming use of a structure and land in <br />combination shall not be extended or enlarged after passage of this ordinance by <br />attachment on a building or premises of additional signs intended to be seen from offthe <br />premises, or by the addition of other uses of a nature which would be generally prohibited <br />in the district in which such use is located. <br /> <br />SECTION 8.2 - AVOll)ANCE OF UNDUE HARDSHIP <br /> <br /> To avoid undue hardship, nothing in this ordinance shall be deemed to require a <br />change in the plans, construction, or designated use of any building or development on <br />which actual construction was lawfully begun prior to the effective date of adoption or <br />amendment of this ordinance and upon which actual construction has been carded on <br />diligently. Where demolition or removal of an existing building has been substantially <br />completed preparatory to rebuilding, such demolition or removal shall be deemed to be <br />actual construction, provided that the work shall be carded on diligently. Actual <br />construction is hereby defined as work done which is beyond the preparation stage and <br />into that stage where the changes or additions are made permanent. <br /> <br />CHAPTER 9 - IMPROVEMENT LOCATION PERMIT <br /> <br />SECTION 9.0 - APPLICABILITY <br /> <br />The Building Inspector, or his agent, shall be responsible for the issuance of all <br />Improvement Location Permits for an alteration to the condition of land, <br />structures thereon, within the Jurisdiction Area of the Commission. Any persons <br />making said alterations must obtain an Improvement Location Permit for said <br />alterations from the Commission prior to the start of any construction. <br /> <br />B. The filing fee for an Improvement Location Permit is shown on Table 2, which is <br /> hereby established as a part of this Section. <br /> <br />SECTION 9.1 - CERTIFICATE OF OCCUPANCY <br /> <br />A. A. Certificate of Occupancy shall be applied for concurrently with the <br /> Improvement Location Permit. <br /> <br />B. No land shall be occupied or used and no building hereafter erected, altered or <br /> reconstructed shall be occupied or used, in whole or in part, for any purpose <br /> whatsoever, until a Certificate of Occupancy has been issued by the Building <br /> 78. <br /> <br /> <br />
