ORDINANCE NO. q__, 1978 <br /> <br />SPECIAL ORDINANCE RHZONING REAL ESTATE IN THE <br /> MOORESVILLE, MORGAN ~UNTY, INDIANA <br /> <br />TOWN OF <br /> <br /> WHEREAS, the Mooresville Plan Commission has held a <br />public hea~ng pursuant to a petition for rezoning file~ by <br />Clifford and Eva Kirk as fee simple owners and by Franchise <br />Realty Corporation as option holders, which petition was docketed <br />as Plan Commission Docket No. 5, 1977, and <br /> WHEREAS, the Mooresville Plan Commission has recommended <br /> to the Board of Trustees of the Town of Mooresville, Indiana, that <br /> the petition be granted upon certain conditions from the present <br /> district classification "A" Single-family to %he district classi- <br /> fication "LB" Local Business, and <br /> WHEREAS, the said Board of Trustees of the civil Town <br /> of Mooresville, Indiana, having heard further evidence on the <br /> Petition For Rezoning, the said Board does now accept the recom- <br /> mendation of the Mooresville Plan Commission and the following <br /> described real estate located in the Town of Mooresville, Indiana, <br /> is now rezoned from district classification "A" Single-family to <br /> district classification "LB" Local Business, subject, however, to <br /> the following agreed stipulations and conditions as and between <br /> the Board of Trustees of the civil Town of Mooresville, Indiana, <br /> <br />and the Petitioners. Such conditions <br /> <br />upon are as follows: <br /> <br /> 1. The owner will dedicate <br />ville, Indiana, the proposed twenty <br /> <br />and specifications agreed <br /> <br />to the civil Town <br />(20) foot alley as <br /> <br />of Moores- <br />shown on <br /> <br />the plat submitted to the Mooresville Plan Commission and to the <br />Board of Trustees of the civil Town of Mooresville, Indiana, and <br />said Petitioners shall improve the alley to the town's specifi- <br />cations with approval of the engineering consultant to the town <br /> <br />as to adequate drainage. <br /> <br /> <br />
