ORDINANCE NO. q__, 1978 SPECIAL ORDINANCE RHZONING REAL ESTATE IN THE MOORESVILLE, MORGAN ~UNTY, INDIANA TOWN OF WHEREAS, the Mooresville Plan Commission has held a public hea~ng pursuant to a petition for rezoning file~ by Clifford and Eva Kirk as fee simple owners and by Franchise Realty Corporation as option holders, which petition was docketed as Plan Commission Docket No. 5, 1977, and WHEREAS, the Mooresville Plan Commission has recommended to the Board of Trustees of the Town of Mooresville, Indiana, that the petition be granted upon certain conditions from the present district classification "A" Single-family to %he district classi- fication "LB" Local Business, and WHEREAS, the said Board of Trustees of the civil Town of Mooresville, Indiana, having heard further evidence on the Petition For Rezoning, the said Board does now accept the recom- mendation of the Mooresville Plan Commission and the following described real estate located in the Town of Mooresville, Indiana, is now rezoned from district classification "A" Single-family to district classification "LB" Local Business, subject, however, to the following agreed stipulations and conditions as and between the Board of Trustees of the civil Town of Mooresville, Indiana, and the Petitioners. Such conditions upon are as follows: 1. The owner will dedicate ville, Indiana, the proposed twenty and specifications agreed to the civil Town (20) foot alley as of Moores- shown on the plat submitted to the Mooresville Plan Commission and to the Board of Trustees of the civil Town of Mooresville, Indiana, and said Petitioners shall improve the alley to the town's specifi- cations with approval of the engineering consultant to the town as to adequate drainage.
