2. The present dedicated alley as shown on the plat as submitted will be closed pursuant to statute with the consent of the Civil Town of Mooresville, Indiana. 3. A six (6) foot shadowbox fence shall be installed and maintained on the West line of the proposed new alley by the Petitioners or their successors and assigns. 4. The property owner shall agree to dedicate to the Civil Town of Mooresv ~le, Indiana, a right-of-way of approxi- mately fifteen (15) feet on and along the East line of the real estate now owned by the Petitioner for the purposes of effecting in the future widening of South Indiana Street. 5. In exchange for the dedication of such permanent right-of-way for the widening of South Indiana Street, the Board of Trustees of the Civil Town of Mooresville, Indiana, shall assume and agree to pay the cost of removing the present MacDonald's sign from its present location to a further point West, if necessary, to effect the widening of South Indiana Street. The real estate subject to the petition for rezoning and which is rezoned by the terms and conditions of this special ordi- nance is more particularly described as follows: The East half of Lot Numbered Two (2) in Block Numbered Sixty-six {66) in Samuel Moore's Fourth Addition to the Town of Mooresville, Morgan County, Indiana. This Ordinance executed on this ~ day of ~y, 1978, confirming the action taken by the Board of Trustees of the civil Town of Mooresville, Indiana, at its regular scheduled meeting on the 4th d~y of April, 1978.
