<br />~ <br />! <br /> <br />-'-- <br /> <br />'---' <br /> <br />'---. <br /> <br />~iocresv l11e P len Conmiss ion <br />November 19, 1973 <br /> <br />The Mooresville Plan Conmission met in regular session on <br />November 19, 1973, at 7:30 P.M. Those members present were: Steve <br />Edwards, Bart Hensley, Hank Gajderowlcz, Rich Keller and Eweather <br />Stephens. Mr. David Lawson, attorney for the Town Board was also <br />present. <br />Minutes of the last regularly scheduled meeting were read and <br />approved. <br />There was no old business to come before the board. <br />David Loudermilk and Winston Tackett, members of the Zoning <br />Board were present to discuss some problems of violation of the Terms <br />of a variance granted at the old Kendrick Hospital property located <br />at 130 N. Indiana Street. <br />Mr. Robert Heath of RR #3, Box 274, Mooresvllle, Ind. 46158, and <br />a I so owner of the prope rty in ques t ion, vo 1 unta r i 1 y appeared be fore <br />the Plan Commission to defend his position as owner of the afore- <br />mentioned property. "1r. Heeth st2ted thct an advertisement for <br />sleeping rooms at said property was placed in the Mooresville Times <br />without his knowledge, by the person whom he had hired to manage <br />the Upstairs apartments. Upon learning of the advertisement, which <br />was in violation of the variance granted, he retracted the advertise- <br />ment and informed the manager of the act. The Plan Conmisslon was <br />assured by Mr. Heath that he plans to operate within the variance, whicn <br />grants apartments, not single rooms, upstairs and Business offIces <br />downstairs. <br />The fact of the property manager maintaining his sleeping quarters <br />downstairs In the building constituted a violation of the variance <br />was pointed out to Mr. Heath, and he stated that to further comply <br />with the terms of the variance the property manager would move his <br />quarters upstairs in the building. <br />After having heard arguments from the Zoning Board members and <br />Mr. Heath's promise of Compliance with the variance as grantedin <br />March of 1973, a motion was made by Hank Gajderowicz that Mr. Heath <br />be allowed to operate the property located at 130 No. Indiana St. as <br />an Apartment & Business Office building so long as the terms of the <br />variance are complied with. The motion was seconded by Bart <br />Hensley and was carried. <br />There being no further business,to come before the Plan Conmission, <br />aupon motion made by Bart Hensley and seconded by Hank Gajderowlcz, <br />the meeting was adjourned. <br /> <br />~;,;/~ <br /> <br />ecretary <br /> <br /> <br />J~(A p lu~ <br /> <br />Pres ent <br />
