CLERK SUPERIOR COURT 1 <br /> <br /> MOTION TO APPEAR AND SHOW CAUSE. <br /> <br /> Comes now the Petitioners, James and Julia Remster, and hereby request the Court to <br /> issue an Order to Appear and Show Cause as to why Michael Young as member ofthe <br /> Mooresville Plan Commission should not be held in contempt of this Court's order of April 9, <br /> 1999 as in support thereof and would show the Court as follows: <br /> <br /> 1. On April 9, 1999 this Court issued an order directing the Mooresville Plan <br /> Commission to approve the Minor Plat of James and Julia Remster which matter was at issue in <br /> the above captioned cause of action. <br /> <br /> 2. That subsequent to the issuance of said order the Plan Commission met on or <br /> <br /> about May 27, 1999. <br /> <br /> 3. Board member Mike Young abstained from the vote taken to approve the Minor <br /> Plat. <br /> <br /> 4. The Commission's vote was 4-0 with Mike Young abstaining. Five affirmative <br /> votes were needed for passage. The issue was automatically tabled to the June meeting. At that <br /> meeting Mike Young stated "I can't make a decision on this right now." <br /> <br /> <br />
