MOORESVILLE BOARD OF ZONING APPEALS
FINDINGS OF FACT
SPECIAL EXCEPTION

A Special Exception request was filed by Mr. Wayne Pace of
269 N. Monroe St., Mooresville, Indiana the 8th day of August,
2002. Mr. Pace had requested a Special Exception for the use of
mini warehouses in a B-2 (local business) zoning classification.
The Mooresville Plan Commission had made a previous Finding that
the location and character of the Special Exception would not
affect the Master Land Use Plan.

The Board having heard evidence makes the following
Findings:

1. The establishment, maintenance or operation of this
Special Exception would be detrimental to and endanger the public
health, safety, morals and general welfare of the community due
to the location of the Special Exception adjoining Residential
Uses including an apartment complex and single family dwelling
which are not compatible with this use.
2. The Special Exception would be injurious to the use and
enjoyment of other properties in the immediate vicinity of the
Residential Uses already permitted due to the traffic and
existing access which is also shared with residential users.
There are small children in the area and limitations on the
access that make it unsafe.

3. The establishment of the Special Exception will not
impede or substantially alter the normal and orderly development
and improvement of the surrounding property for uses permitted in
the district.
4. There are adequate utilities, there is some question as
to the access road which also serves a Residential Use.
5. Adequate measures as proposed still left issues as to
ingress and egress design as to the width of the ingress and
egress but there is no problem as to traffic congestion on the
public road.
6. This Special Exception of a warehouse is allowed in a B-
2 zoning.

Based upon the above Findings, the Mooresville Board of
Zoning Appeals denies the requested Special Exception this 8tn
day of August, 2002.
