MOORESVILLE BOARD OF ZONING APPEALS <br /> FINDINGS OF FACT <br /> <br /> The Board of Zoning Appeals met March 16, 1994 at 7:00 p.m. on <br />the petition for special exception filed by Arvin Hopkins and Mary <br />Hopkins for a sand and gravel mining operation on 50 acres of real <br />property currently zoned Agricultural (said real property more <br />particularly described in the attached Exhibit "A"). The <br />Mooresville Plan Commission, in it's February meeting, found that <br />the location and character of the proposed special exception would <br /> <br />not effect the master land use plan in an adverse manner. The <br />Board then proceeded to a public hearing and pursuant to the <br />discussion following the public hearing makes the following <br /> <br />findings of fact under Chapter 5, Special Exception Procedures, <br />the civil Town of Mooresville's Zoning Ordinance: <br /> <br /> 1. That the establishment, maintenance, or operation of the <br />special exception would not be detrimental to or endanger the <br />public health, safety, morals, or general welfare since this use is <br />merely an extension of the existing sand and gravel mining <br />operation and that there have been other similar operations in this <br />area. <br /> <br /> 2. The special exception would not be injurious to the use <br />and enjoyment of other properties in the immediate vicinity for the <br />purposes already permitted in that this type of use already exists <br />in the vicinity. <br /> <br /> 3. That the establishment of the special exception will not <br />impede or substantially alter the normal and orderly development <br />and improvement of surrounding property for uses in the district <br /> <br /> <br />
