Lela Ewers of 11240 North Cooney <br /> Road, asked if they could put another business there, Mr. Currens told the Mrs. Ewers <br /> that what is before this board is to meet the requirements for a minor plat, it is not a <br /> rezone petition Mr. Currens stated that what is still needed is a statement from the Health <br /> Dept. Lela Ewers ask for clarification of a road cut, Mr. Currens explained that it was a <br /> drive way permit. With no other comments or questions a motion was made by <br /> Commissioner Logan, seconded by Commissioner Berwick to approve the petition for the <br /> Minor Plat with the stipulations that follow 1: Letter from County Board of Health saying <br /> that both of the septic fields meet their standards. 2: Certification that the drainage will <br /> not increase. 3: show recorded easements for the septic fields 4: a road cut permit the <br /> motion carried 8-0. <br /> The next item on the agenda was John Drapalik for RK Enterprises asking for a Plat <br /> amendment. They are asking for a set back in the front from 30 to 25 feet and the rear <br /> from 25 to 15 feet, this would accommodate larger garages for the new homes they are <br /> planning, these would be single family homes. The will still have the 16 feet between <br /> buildings. Commissioner Brown asked if there were fire hydrants there Mr. Russell said <br /> that they were owned and serviced by Indiana American Water Co. Commissioner <br /> Williamson ask if the original plan was to build condos around the pond, Mr. Russell said <br /> that yes, that was planned two or maybe one double on the east side of the pond, to reach <br /> the goal of density up to 50 units. With this proposal the density would change to 45 or <br /> 46. Mr. Russell said that they are proposing a more narrow building and a little longer to <br /> accommodate for sales they would to 1,500 to 1,600 square feet. He said that this would <br /> give them a third garage and would eliminate some of the visisabilty of drive ways. <br /> This will also forces more rain water at the gutter line pushing it down the street more <br /> rapidly and more equally down the back swell. Commissioner Williamson about build <br /> any closer to State Road 144 Mr. Russell said that there is a 75 foot set back from state <br /> Highway right of way and they did not want to build any closer to the Highway. Phyliss <br /> Cottongim came forward, she said that 16 years ago this project was supposed to be a 2 <br /> year project and that they were supposed to work with the neighbors on the drainage. <br /> Mrs. Cottongim brought pictures of the conditions after rains. Mrs. Cottongim said that <br /> they have a shed that they pay taxes on but cannot use most of the year because of <br /> standing water, she said that they have hauled in 4 loads of dirt and still not able to get to <br /> this building. Even in normal years they are lucky to mow by the end of August. At this <br /> time James Cottongim came before the board to say that the tile for the spill way is <br /> higher then their prosperity,he has filed a complaint with the county and they are <br /> supposed to come up and check it out. Mr. Cottongim went on to mention several things <br /> about the drainage to and from the Condos. He was said that the small swell does now <br /> help; it fills and backs up against him. He asked that the set backs changes not be <br /> approved, as it would be more drainage on his property. Mr. Russell responded by saying <br /> that yes there had been crawl-space issues that have been addressed but some of the ones <br /> that were mentioned were because of the home owner altering the terrain. He also feels <br /> that the drainage from the church property is causing some of the problem, and maybe <br /> they need a retention pond. <br /> He said that are not adding units, they are reducing the count as well as the sizes of the <br /> dwellings; they feel that they are enhancing the look of the property by adding the garage <br />
