5~~ <br />Dale Gray, Morgan County History and Geneology Association appeared before the <br />Council. She had previously asked permission to work on the Old Cemetery on West <br />Washington Street. She also broached the subject of funding. A motion was made by <br />Councilman Wa.rthen, a second by Councilman Bryant to offer the Cemetery Sexton <br />Eddie Bucker's services, but to not donate money at this time. Motion carried 5-0. <br />NuGenesis-Tax Abatement request- Councilman Warthen said he was trying to keep <br />Tox-A Ways from Recycling straight in his mind. Jim Parker, Owner, gave the Council a <br />handout listing all light de-manufacturing processes and told the Council they do provide <br />service to collect household wastes, paints/thinners etc., to dispose of. He told the <br />Council these wastes stay sealed and the EPA says these are non-hazardous as they are <br />transferred fraxm one Semi to another. They hold for 60-90 days until a processor comes <br />along and removes them from the premises. They cross dock, only, at their building. <br />Councilman Mathis told Mr. Parker he was on the Board of West Central and he thinks <br />we don't know what is in the barrels. He asked Mr. Parker how they knew. Mr, parker <br />said materials you don't know you put in a HAZ cabinet and sometimes there is l% not <br />identified by technicians. Joe Beikman, Building Inspector, told the Council that <br />definition wise this did not fit in our zoning classification. Mr. Beikman said the Plan <br />Comunission had no problem with just the recycling, but Tox-Aways on site was not in <br />the zoning classification. Town attorney Tun Currens said that under an I 2 zoning if <br />chemicals are on the site and in case of a spill with Tox-sways kept then this would not <br />be an allowable use. He said it would be an I-3 zoning. Mr. parker said that IDEM didn't <br />mention in the Grant the zoning classification should be an I-3. He said he may have to <br />do a rezone process to an I-3. Tim Currens told Mr. Parker to get with Joe Beikman to <br />see where the classification fits. <br />Town attorney Tim Currens had a Building Appraisal Update from Dan Clark for the <br />Council to review and vote upon. The cost will be $450.00. A motion was made by <br />Councilman Mathis, second by Councilman Clark that based upon our insurance carrier it <br />is important to keep this updated, so this was a motion to approve the appraisal updates. <br />Motion carried 5-0. <br />Next, the 77 Pension for Police and Fixe was on the agenda. President Toby Dolen told <br />of several experiences in which the police or fire department had to report bad news or be <br />in dangerous, sometimes deadly situations. Councilman Bryant explained. that <br />$283,162.00 with interest was close to $353,000.00. He also said that legislation to now <br />drop the age from S2 to 50 did fail, but lobbying will get that changed. President Dolen <br />said he was asking for this buy-back right here. He wanted to give the best possible <br />pension. A motion was made by Councilman Clark to approve this buyback. No second <br />for the motion was forthcoming, so the motion died. Councilman Mathis told the Council <br />that the Town of Mooresville paid the employee's part in the original buyback, which <br />most Towns do not do this. He explained that trying to do this buyback in the middle of a <br />budget year was not financially sound. He said this needs to be brought up in August <br />when preparing for the budget for 2004. Council President Toby Dolen asked if he could <br />second Councilman Clark's motion. Attorney Tim Currens answered no. A motion was <br />made by Councilman Worthen, second by Councilman Mathis to re-address this issue in <br />August when preparing for the 2004 budget. Motion carried 4 in favor and 1 opposed. <br />Cauncilrnan Bryant opposed. <br />Legal: Attorney Tun Currens had a resolution for the sale of two police cars to Decatur <br />Township for $9,000.00 each. A motion was made by Councilman Worthen, second by <br />Councilman Mathis to approve this resolution. Motion carried 5-0. <br />Fire Chief, Les Farmer, informed the Council the pumper was back from being re- <br />furbished. <br />Councilman Bryant asked Joe Beikman if the dumpster sitting on the brick sidewalk in <br />front of the Methodist Church could be moved. He said it needs to be on the street. Mr. <br />Beikman will call Ray's Trash. <br />Animal Control tJfficer, Mark Taylor, reported thirteen (13) calls, two (2) impounded, <br />and two (2) returned. <br />A motion was made by Councilman Worthen, second by Councilman Clark to approve <br />payment of the claims. Motion carried 5-0. <br />
