BOARD OF ZONING APPEALS <br /> MINUTES <br /> APRIL 14, 2011 <br /> The Town Of Mooresville Board of Zoning Appeals met on April 14, 2011 at the <br /> Mooresville Government Center at 4 e. Harrison. Street. <br /> Members present were Chairman Neal Allman, Ann Whaley and Alan Kramer. Mike <br /> Young was absent. Town Attorney Tim Currens was present for the first item on the <br /> agenda, he excluded him self from the Special Exception. <br /> The meeting was called to order by Chairman Allman at 6:00 p.m. at this time he asked <br /> for any questions or corrections on the minutes from March 10, 2011. With no question <br /> or corrections a motion was made by Alan Kramer seconded Ann Whaley to approve the <br /> minutes as written. The vote was 3-0 with none opposed. <br /> Carl Van Essen came before the Board asking for a variance to operate a small engine <br /> repair shop at 12527 N Keen Drive. The property is zoned Agricultural at this time. Mrs. <br /> Whaley asked if this was the same property that a transmission shop was on. Mr. Van <br /> Essen said that yes it was. He went on to say that he is not planning any big changes,just <br /> cleaning the property up and to have a business when he retires. Storage was discussed <br /> Mr. Van Essen said that he would only have inside storage. Signage was also discussed. <br /> With no other questions from the board or the audience Mr. Allman read the Findings of <br /> Facts after which a motion was made by Ann Whaley motioned to approve this variance <br /> stipulating that the existing garage be the only structure used for the small engine repair, <br /> there will be only inside storage with no outside storage, and any signage be no larger <br /> than six square feet with no lighting. Alan Kramer seconded the motion,the motion <br /> carried 3-0 with none opposed. <br /> The next item was Mark Peden asking for a special exception for the Jessup property on <br /> Greencastle Road, at this Mr. Currens excused himself because of conflict of interest. <br /> Mark Peden representing American Solar came before the board asking for a special <br /> exception for the Jessup property on Greencastle Road to build a solar farm. Mr. Peden <br /> identified the property on Greencastle Road as being rural with cornfields etc., he also <br /> mentioned the Citizens Gas property adjoins this property. When the solar panels are <br /> installed the will generate enough energy to support 750 to 900 homes after being sold to <br /> 1P&L. Mr. Peden explained that this special exception would be less intrusive then what <br /> is there now, the panels are black there will be no glare, no dust, no odor and no noise. <br /> He also said that there is very little activity at the site.There will be green escaping to the <br /> east buffering the three properties on that side, also to the road. (he had plans for the land <br /> scrape) He said that the panels would be about 7 feet high. At this time he said that if this <br /> special exception is granted, they will go before the Plan Commission to be sure that the <br /> special exception would be in conflict with the Master Plan.
