• Crossing Lot Owners Association would be responsible for storm water <br /> maintenance <br /> and repair, if they fail to maintain the Storm water systems the town may impose a <br /> fee to each lot owner for the repair. If these fees are not paid a lien can be put on the <br /> property. The property owner next to the south will have a quick deed for that piece <br /> of land at the south, next to their fence. After much discussion on the amount brick <br /> and masonry on the homes, the use of other sidings, and the size of the out buildings, <br /> lot depths and width. Commissioner Logan had concerns about the amount of <br /> homes in the project and the traffic study.Mr. Holloway said that he felt that the 2.2 <br /> density was in line with this type of custom homes. Commissioner Logan took <br /> y ft-i ' acepting to the traffic study,Mr. Holloway said that ANF is one of the best firms in <br /> 1t- Indianapolis for traffic study's, and that they say there will be a little problem in the <br /> service for Hadley Road. There will be a right turn lane at 67 and Hadley road.At <br /> this time Chairman Young asked for questions from the audience. Mrs. Mathers of <br /> 4975 Neitzel Road if Mahoney Homes said she would like to see them go to 100 <br /> brick.Joe Beikman gave his idea of pros and cons of having all brick homes. After <br /> more discussion about the °A) of brick and the question about what happens if the <br /> lots do not sell. It was said that if,it did happen that the lots did not sell and the <br /> builder wanted to change anything from the original plans or restrictions.It was <br /> decided that any changes would come to the Planning Commission for any changes. <br /> The front set backs were brought up again from 30to 40 feet. A motion was made <br /> by Commissioner McGuire for a favorable recommendation to the Town Council <br /> for the rezone of the Jessup property with the changes to the requirements for the <br /> PUD. The motion was seconded by commissioner Ehrhart, motion carried 6-0 with <br /> none opposed. <br /> The next item before the commission was Holloway for Rick Allison a rezone from <br /> Ag.to I-I on County Line Road. Mr. Holloway explained that the rezone was for lot <br /> 1 of the second minor plat. This would allow the expansion o f A & A Transmission. <br /> With no questions a motion came from Commissioner McGuire and seconded from <br /> Commissioner Logan for a favorable recommendation to the Town Council. The <br /> motion carried 7-0 with none opposed. <br /> The next item was Holloway for Karen Overpeck, for the land at the point between <br /> Old State Road 67 and State Road 67 to be rezoned B-3. Mr. Holloway explained <br /> that this would be a straight B-3 with the stipulation that there would be no bars, <br /> liquor stores or night clubs would be built. A motion was made by Commissioner <br /> Logan seconded by Commissioner McGuire for a favorable recommendation to the <br /> Town Council for the B-3 rezone. Motion carried 7-0 with none opposed. <br /> Holloway for David Oberle asking for a replat of Lot 8 Pioneer Country Estates. <br /> The reason for asking for this rezone is moving a drainage easement so as to build <br /> a swimming pool. Mr. Holloway said that it would not impact the drainage at all. <br /> Motion to send this replat to Town Council with a favorable recommendation was <br /> made by Commissioner Ehrhart, second by Commissioner Berwick. The motion <br /> • carried 7-0 with none opposed. <br />
