regards to the subdivision control ordinance that a variance would <br />also have to be approved to allow for a waiver of the depth to <br />width ratio. The board then considered the requirements of <br />Indiana Code 36-7-4-918.5 pertaining to variance from development <br />standards. The board found that: <br /> <br /> 1. Approval would not be injurious to the public health, <br />saftey, morals and general welfare of the community since the area <br />was presently being developed for residential use and the proposal <br />only increased the density of that use in that the applicants were <br />desiring to place two residential homes on three acre lots instead <br />of one residential home on a six acre lot. Further, with regard <br />to the depth to width ratio the land in question is of sufficient <br />size so as not to create a health or safety problem. <br /> <br /> 2. The use and value of the area adjacent to the property <br />included in the variance would not be affected in a substantially <br />adverse manner since developing the tracts with residential homes <br />would increase the value of other homes adjacent to the <br />petitioners' property. Further, with regards to the depth to <br />width ratio the land will be of similar size to other parcels of <br />land in the immediate area. <br /> <br /> 3. The strict application of the terms of the zoning <br /> ordinance would result in practical difficulties in the use of the <br /> property in that the proposed construction would in all likelihood <br /> not be economically feasible if the requirements of the <br /> subdivision control ordinance were required to be maintained. The <br /> depth to width ratio is more of a concern for small tracts of land <br /> in a normal subdivision where the lots are significantly smaller <br /> <br />-2- <br /> <br /> <br />
