FINDINGS OF FACT <br /> <br /> RE: Stephen A. and Cheryl L. Edwards <br /> Donald M. and Bobbie S. Barry <br /> Lots 1, 3, 4, 5, 6, 7, 8 and 11, North Point Subdivision <br /> <br /> This matter came before the Mooresville Board of Zoning Appeals <br />on December 1, 1987 at a specially called meeting. The petition <br />requested a variance from the development standards as to the lot <br />size to have two-family dwellings placed on the property. <br /> <br /> The Mooresville Board of Zoning Appeals having heard evidence <br />on the above captioned petition now makes the following findings <br />of fact pursuant to I.C. 36-7-4-9-18.5: <br /> <br /> 3. That the approval would not be injurious to the public <br />health, safety, morals and general welfare of the community and <br />that the nature of the lot size was not significant to other <br />potential uses of the property which would have up to three family <br />dwellings. <br /> <br /> 2. That the use and value of the area adjacent to the property <br />included in the variance would not be affected in a substantially <br />adverse manner in that if small homes were put in or three family <br />dwelling units the values could be affected and for this reason <br />the granting of this variance would not have any substantial impact <br />on the area. <br /> <br /> 3. That the strict application of the terms of the zoning <br />ordinance would result in practical difficulties in the use of the <br />property in that it could be used for one or three family units as <br />it currently existed. <br /> <br />Dated: <br /> <br /> <br />
