FINDINGS OF FACT

RE: Stephen A. and Cheryl L. Edwards
Donald M. and Bobbie S. Barry
Lots 1, 3, 4, 5, 6, 7, 8 and 11, North Point Subdivision

This matter came before the Mooresville Board of Zoning Appeals
on December 1, 1987 at a specially called meeting. The petition
requested a variance from the development standards as to the lot
size to have two-family dwellings placed on the property.

The Mooresville Board of Zoning Appeals having heard evidence
on the above captioned petition now makes the following findings
of fact pursuant to I.C. 36-7-4-9-18.5:

3. That the approval would not be injurious to the public
health, safety, morals and general welfare of the community and
that the nature of the lot size was not significant to other
potential uses of the property which would have up to three family
dwellings.

2. That the use and value of the area adjacent to the property
included in the variance would not be affected in a substantially
adverse manner in that if small homes were put in or three family
dwelling units the values could be affected and for this reason
the granting of this variance would not have any substantial impact
on the area.

3. That the strict application of the terms of the zoning
ordinance would result in practical difficulties in the use of the
property in that it could be used for one or three family units as
it currently existed.

Dated:
