The tenant does not pay for the sewage bill. <br />Warren Franklin advised that all utilities need to be on a separate <br />system per town ordinance. <br /> <br /> Chairman Oschman asked if there were any conditions attached <br /> <br />to the prior variance given to the previous owners of the property. <br />Mrs. Harris responded that to her recollection the only restriction <br />was that there would be no parking on Maple Lane. <br /> <br /> The Board proceeded to consider the variance from use standards <br />and made the following findings: <br /> <br /> 1. That the approval of this variance would not be injurious <br /> to the public health, safety, morals and general welfare <br /> of the community due to the fact that the neighborhood is <br /> presently residential. <br /> <br /> 2. The use and value of the area adjacent to the property <br /> included in the variance will not be affected in a <br /> substantially adverse manner in that there are currently <br /> apartments close by in the neighborhood. <br /> <br /> 3. The need for the variance arises from some condition <br /> peculiar to the property involved in that the apartment was <br /> originally constructed as a donut shoppe and if not allowed <br /> to be used as a residence, then the property would have to <br /> be rezoned or a variance obtained for allowing a business <br /> to operate on the property; <br /> <br /> 4. The strict application of the terms of the zoning ordinance <br /> would constitute an unnecessary hardship if applied to the <br /> property for which the variance is sought in that there are <br /> and have been two buildings located on this one parcel of land; <br /> <br /> <br />
