5. The approval does not interfere substantially with the

comprehensive plan adopted by the Town of Mooresville in
that the area is presently zoned residential and the
granting of this variance will allow the property to remain
residential.

Finding that all five requirements were met Tilford Bailey moved
to grant the variance to allow for two dwellings on one lot
contingent upon this variance having any restrictions which were
previously imposed on the prior owner's petition for variance,
namely, Richard Roberts approximately two to three years ago. The
motion was seconded by Warren Franklin and unanimously carried. The
Board then requested the Board attorney to review the minutes of
the meeting in which the Roberts variance was granted and to determine
if any conditions were placed thereon.

The next item on the agenda was the petition requesting a
variance to allow multi-family apartments in an area zoned "A"
residential to allow for the continuation of four (4) apartments
in Mr. Reed's home. Present representing Mr. Reed was attorney
Roscoe Stovall. Mr. Stovall stated that the request was not
incompatible with the environment. He advised that Mr. Reed was
presently modifying his home and had received the proper permits to
do so. He further advised that Mr. Reed was in the concrete con-
struction business which was seasonal and that this was his only
source of income.

Mr. Stovall advised that the home was too large

himself and that in the past Mr. Reed had employees

business living in the apartments.

for Mr. Reed

in his construction

- 3 -
