FINDINGS OF FACT <br />Mooresville Board of Zoning Appeals <br />Re: Variance Request of Stephen A. Edwards, <br /> Cheryl A. Edwards and Dorothea Edwards, <br /> 292 W. Harrison Street, Mooresville, IN 46158 <br /> <br /> This matter came before the Mooresville Board of Zoning Appeals on <br />Wednesday, February 19, 1986, at the regularly scheduled meeting date and time. <br />The petition requested a variance from the zoning ordinance, in particular, a <br />variance from the setback line on Harrison Avenue, where it runs north and south <br />so as to extend the existing building to the west to build within twenty-five (25) <br />feet of the existing pavement of Harrison Avenue. <br /> <br /> The Mooresville Board of Zoning Appeals, having heard evidence on the <br /> <br />above captioned petition now makes the following findings of fact pursuant to <br />Indiana Code 36-7-4-918.5: <br /> <br /> 1. That the approval will not be injurious to the public health, safety, <br />morals and general welfare of the community due to the location of the existing <br />structures and proposed structures on the respective Lots #11 and #12, and in <br />the adjoining property. <br /> <br /> 2. That the use and value of the area adjacent to the property included <br /> <br />in the variance will not be affected in a substantially adverse manner due to <br />the other businesses in the area and the fact that this is currently general <br />business and theproperty affected is owned by one of the petitioners. Further, <br />that this land would be sold as a unit according to the petitioners. <br /> <br /> 3. That the strict application of the terms of the zoning ordinance will <br /> result in practical difficulties in the use of the property due to the property <br /> already existing so close to the respective property lines and with the general <br /> business zoning classification any other use of the property would not be practical. <br /> <br />Dated: <br /> <br />Chairman <br /> <br />Secretary <br /> <br /> <br />
