That the use and value of the area adjacent to the property included <br /> in the variance would not be affected in a substantially adverse manner <br /> in that the property was surrounded by the gravel pit area and the <br /> residents were buffered by the highway and large front yards. <br /> <br /> 3. That the need for the variance arises from a condition peculiar <br /> to the property involved, that being the fact that it is apart <br /> of the partial currently being mined for gravel and sand. <br /> <br /> 4. The strict application of the terms of the zoning ordinance <br /> would constitute an unnecessary hardship if applied to the property <br /> for which the variance is sought due to the location of the gravel <br /> pit area and surrounding areas. <br /> <br /> 5. The approval does not interfere substantially with the <br /> comprehensive plan adopted under the 500 Series of this <br /> Chapter. <br /> <br /> The parties then proceeded to discuss potential restrictions including <br />signs, business in or out of the home on the property, equipment storage, and <br />the state highway street cut. Paul Walters then made a motion to grant the <br />variance based upon the findings of fact with the following restrictions to be <br />added to the variance to allow operation of E-Z Way Rental Sales as a tool <br />rental business, sale and repair of small engines, and the leasings of trailers <br />and trucks, said restrictions to he as follows: <br /> <br /> 1. That no other type of business be run on the property and no <br /> business to be done out of the personal residence on the property <br /> with the exception of answering the phone and people stopping by <br /> after hours to get someone to come over to the business.
