Mr. Hopkins regarding a clean up of the highway for dust and dirt pollution <br />problems could have been accomplished without any interference from the <br />State Highway Department. He then stated that Mr. Hopkins had refused to <br />have anything in the contract regarding this based upon the fact that the <br />State Highway wouldn't let him clean it up. Again he stressed that there <br />was no credibility in dealing with this petitioner. <br /> <br /> The next person to speak was Wilbur B. Johnson of 605 State Road 267 <br />who stated that this property was visible from the business and that he also <br />felt that Mr. Hopkins would do as he pleased which would include not keeping <br />up his property. <br /> <br /> Kay Smitherman then spoke again and advised tha she realized this Board <br />had inherited some of these problems and feels the agreements have not been <br />complied with in the past. Wendell Thaler spoke and stated that this Board <br />this evening was not dealing with the contract with the Town Board but only <br />the petition at hand. Mrs. Smitherman advised that she understood that but <br />the main thrust of her complaints were that the business has been operated <br />illegally for five years and a variance would open up this area for business. <br />Mr. Campbell advised that he brought this up to show there had been existing <br />problems and also felt the street cut was still an issue with the State Highway <br />Department. Mr. Beck advised that an application had been applied for with the <br />State Highway Department and that Delbert Hobson was making some drawings for <br /> <br />them. He advised that there was no current approval but it was applied for. <br /> The Board then proceeded to a discussion of the case. <br /> <br /> 1. The Board first found that the approval would not be injurious <br /> to the public health, safety, morals and general welfare of the <br /> community in this location. <br /> <br />-9- <br /> <br /> <br />
