Mike Young and Jeff <br /> Dieterlen stated that this proposal had been through technical review committee with no issues. <br /> Jeff Dieterlen questioned what would become of the property should the sale not occur as the <br /> property as requested does not have access and there for could not stand alone. John Larrison, for <br /> Holloway Engineering explained that the timing of all steps is intricate; the plat would not be <br /> recorded until all sales were complete, then Mr Maddox the new owner could/would record the <br /> property as one piece of merged property. .leff Dieterlen made a motion to pass on the <br /> contingency that the sale, filing and recording happened as stated. The motion passed. <br /> Ross Holloway presented a PUD amendment to Ordinance 10 — 1999. Ross Holloway presented <br /> an overview of the previously approved ordinance to the Commission members and the <br /> audience. Ross went on to explain that the current plans would reduce the approved 7duplex <br /> condominiums to 13 single family homes. Mr. Holloway explained that this is a decrease in the <br /> possible number of residents and traffic, and that it would create more impervious ground. The <br /> retention areas would be addressed, a berm would be constructed, landscaping would be planted <br /> and studies had been completed regarding the creek behind the property, The covenant and <br /> restrictions on this proposed project are different, all homes are at least 2 bedrooms, 12 pitch <br /> roof, there will be a board, homeowners association and the existing lift station will remain and <br /> maintained by the homeowners association. Ross Holloway showed graphs that illustrate this <br /> project will not increase standing water; water will flow into the stream. Ross Holloway and Tim <br /> Currens discuss the previously approved plans for run off did not include the current storm water <br /> ordinance, Mike Young opened the floor for questions: Kim Sweeney questioned the need for a <br /> homeowners association, she was worried that residents could be violated for not conforming. <br /> Floyd Duncan from Indiana St asked for clarification of water flow, Ross Holloway reiterated <br /> that if water flow did not meet current standards and studies, by a third party engineering <br /> company that no building permits would he issued. Ross Holloway stated that he would mow <br /> and clean up his portion of the creek to assist with the water flow. Audience members did not <br /> seem convinced that constructing in that arca would assist in the problem, Mr. Holloway once <br /> again reminded the audience that what he was asking in the plan Commission for was an <br /> amendment that plans had already been approved previously to allow building in that area, Mr. <br /> Burnside, a neighbor addressed the driveway size and how increasing the width would reduce the <br /> area his renters use for parking and their privacy would he decreased. Mr. Holloway explained <br /> that increasing the drive would still provide Mr. burnsides property with 12 feet of property to <br /> the fence. Audience member mark Mathis of East St expressed concern with water flow as well, <br /> he also stated concerns that as there is no proposed play area residents of this development may <br /> in cringe upon his adjoining property.
