MINUTES OF MOORESVILLE BOARD OF ZONING APPEALS

The Mooresville Board of Zoning Appeals met in a specially called session
on Wednesday, the 20th day of October, 1982 at 7:30 P.M. at the Mooresville
Town Hall. Present were Board Members Paul Walters, Nan Kollmeyer, Ray House,
Wendell Thaler and Steve Oschman. The Board's Attorney Tim Currens was also
present. The meeting was called to order by Chairman Paul Walters and minutes
of the last meeting were read by all members and approved.

The Board proceeded to the first order of business which was a continuation
of a petition for a variance as a special exception to allow petitioner, Hoosier
Water Company, Inc., to construct and place a water storage tank on a one acre
tract of real estate located on the south side of State Road 144 east of Johnson
Road. The Hoosier Water Company was represented by attorney John E. Mills and
present also Was J. H. Fondren. Mr. Mills explained that the purpose of the
water company installing this storage tank was to use as a holding tank to
supplement and feed the principal water tower north of town. It was the water
company's position that they had a responsibility to the Town of Mooresville to
supply adequate water service and this was one of the purposes of this project.
A Mr. Copeland from the F.C. Tucker Company was present to explain what efforts
he had made on behalf of Hoosier Water Company to procure other properties in the
area for placement of this water storage tank. James Bruner, the Mooresville
Fire Chief, then testified on behalf of the water company as to the benefit the
water storage could provide for the town fire fighters. He explained that there
were certain water pressure problems under circumstances where two mains were
open in close proximity. For this reason Chief Brunet believed that the additional
storage tank would be a benefit to the con~nunity. Fire Chief Darrell Brown from
Brown Township testified that this could be a benefit to the Brown Township

Fire Department especially if there were fire hydrants for him to attach his trucks
