Saddler made a motion to approve, the motion was seconded and passed 8-0-1, Kim Schofield did not vote. Fourth agenda item; Primary Plat at E North County Line Rd Camby, John Larrison presenting on behalf of property owners Fred & Margaret Settle. The petition is establishing a four -lot plat to be known as Settle's Overlook. Lot 1 at 2.4 ac, Lot 2 at 4.53 ac, Lot 3 at 6.33 and lot 4 at 8.39 Mr. Larrison stated that access would be via Meadow Dr, currently a gravel drive that property owner plans to pave, During Commission questions, comments and concerns David Saddler questioned utilities, JD Robinson verified hydrant locations, Tammy VanHook clarified entrance location Mark Taylor questioned existing structures. John Larrison provided utility information, entrance location and its' legal width verses actual width and remarked that existing buildings were being removed. During audience questions and comments William Divis of lot 3 indicated the drive would encroach into his sidewalk and or steps if developed at 50 ft wide, an attorney for Mr. Chapman indicated he had concerns and indicated he would elaborate during the following petition. Ms. Haynes expressed concerns for flooding, additional neighbors indicated the desire of a continuance to verify property values and or plat wording would not be hindered. John Larrison reviewed the request indicated he had consulted the FEMA website for flood zone areas, stated a crushed pipe would be replaced to correct drainage concerns, and clarified the roadway / drive would not be the 50 feet but 16 with 2 -foot gravel shoulders. Kim Scofield questioned if the easement could be relocated, Tammy VanHook verified with property owners that the 16 and 2 would not encroach on their property. Beth Copeland spoke in regards to the current property owners concern on maintenance and easements, she also indicated concerns on voting on a continuance based upon remonstrators requests. Ross Holloway reminded the Commission on its requirements and indicated he was opposed to a continuance. During Commission final comments or concerns Jeff Dieterlen expressed continued concerns then questioned whether to call a vote or for a continuance. Kim Scofield again expressed concerns for flood areas, Beth Copeland clarified that was not a Plan Commission issue and when no further questions were asked or comments made Mike Young called for a motion.
