Saddler made a motion to approve, the motion was seconded and passed 8-0-1, <br />Kim Schofield did not vote. <br />Fourth agenda item; Primary Plat at E North County Line Rd Camby, John <br />Larrison presenting on behalf of property owners Fred & Margaret Settle. The <br />petition is establishing a four -lot plat to be known as Settle's Overlook. Lot 1 at 2.4 <br />ac, Lot 2 at 4.53 ac, Lot 3 at 6.33 and lot 4 at 8.39 Mr. Larrison stated that access <br />would be via Meadow Dr, currently a gravel drive that property owner plans to <br />pave, During Commission questions, comments and concerns David Saddler <br />questioned utilities, JD Robinson verified hydrant locations, Tammy VanHook <br />clarified entrance location Mark Taylor questioned existing structures. John <br />Larrison provided utility information, entrance location and its' legal width verses <br />actual width and remarked that existing buildings were being removed. During <br />audience questions and comments William Divis of lot 3 indicated the drive would <br />encroach into his sidewalk and or steps if developed at 50 ft wide, an attorney for <br />Mr. Chapman indicated he had concerns and indicated he would elaborate during <br />the following petition. Ms. Haynes expressed concerns for flooding, additional <br />neighbors indicated the desire of a continuance to verify property values and or <br />plat wording would not be hindered. John Larrison reviewed the request indicated <br />he had consulted the FEMA website for flood zone areas, stated a crushed pipe <br />would be replaced to correct drainage concerns, and clarified the roadway / drive <br />would not be the 50 feet but 16 with 2 -foot gravel shoulders. Kim Scofield <br />questioned if the easement could be relocated, Tammy VanHook verified with <br />property owners that the 16 and 2 would not encroach on their property. Beth <br />Copeland spoke in regards to the current property owners concern on maintenance <br />and easements, she also indicated concerns on voting on a continuance based upon <br />remonstrators requests. Ross Holloway reminded the Commission on its <br />requirements and indicated he was opposed to a continuance. During Commission <br />final comments or concerns Jeff Dieterlen expressed continued concerns then <br />questioned whether to call a vote or for a continuance. Kim Scofield again <br />expressed concerns for flood areas, Beth Copeland clarified that was not a Plan <br />Commission issue and when no further questions were asked or comments made <br />Mike Young called for a motion. Kim Scofield called for a motion to continue, <br />when no second was made David Saddler made a motion to approve, that motion <br />was seconded and passed 6-3, Mike -Young, -Jeff Dieterlen-and Kim Scofieldvoting <br />=opposed,— <br />
