Councilman Swinney. Motion carried 5-0. President Warthen formally offered the position to <br />Mr. Buckner and he accepted. <br />Rezone of 210 Wheeler Street — Chris and Jasmine Freeman, owners of 210 Wheeler Street are <br />requesting a rezone from R-1 to B-2 for the purpose of operating their small communications <br />business. They have been in business in Indianapolis for approximately 22 years and have lived <br />in Mooresville for 8 years. They have decided they want to have their business in Mooresville, <br />as well. The owners confirmed there will be no customer traffic coming into the business and <br />no outside storage. It was a unanimous recommendation from the Plan Commission for <br />approval, except for Mark Taylor having to abstain since he lives in close proximity to the <br />property. <br />A motion to approve the rezone of 210 Wheeler Street from R-1 to B-2 was made by <br />Councilman Stanley, second by Councilman Williams. Motion carried 5-0. <br />Rezone of 28 E South Street Apts 1-2-3 — On behalf of James Ballard, President of Ballard <br />Properties, LLC, and owner of 28 E. South Street, Holloway Engineering is requesting a rezone of <br />Lot 1 from R-1 to R-2 for the purpose of constructing a two-family dwelling. There is already an <br />existing home on the south end. John Larrison, of Holloway Engineering provided a plat map to <br />the Council. He stated the property is surrounded by B-2 and B-3 uses. The new structure will <br />face west and there will be two driveways, as well as additional parking. The structure will be <br />2400 sq ft, 1200 on each side. It will not affect the zoning of the existing home. The Plan <br />Commission gave a unanimous favorable recommendation. They will still need to request <br />variances for set backs and lot size. <br />A motion to approve the rezone of 28 E. South Street Apts 1-2-3 was made by Councilman <br />Swinney, second by Councilman Cook. Motion carried 5-0. <br />Cell phone discussion — President Warthen told the Council a representative from Verizon had <br />offered to be present at the next meeting to answer questions. Council agreed to wait to <br />discuss and have the rep come to the meeting. <br />Unkept property— Dave Moore, Street Supt, presented two properties to the Council that he <br />has received many complaints on. He is asking the Council for permission to move forward with <br />taking action against the owners. He stated that they have received many letters. One may <br />have been getting letters for as long as 20 years. Legal has called the owners and sent letters <br />as well. One owner called and stated he was older and was trying but after a week or two the <br />progress stopped. Councilman Cook asked when the last contact took place. Dave said it was <br />probably around the end of last year. Councilman Cook stated he would like Dave to reach out <br />one more time and report back at next meeting. Attorney Lee stated that once it was filed in <br />court, it would take about 60 days to get a court order. He stated if the Town takes action, they <br />can put a lien on the property, but the collection part is much more difficult. <br />Councilman Williams made a motion to approve moving forward with legal action on both <br />properties, pending Dave's response at the next meeting. Motion was second by Councilman <br />Cook and carried 5-0. <br />ADA Transition Plan — Legal presented an updated ADA Transition Plan to the Council. It is not <br />100 percent complete, but he hopes it will be finalized by the next meeting or the following. <br />President Warthen stated that he did receive communication from a citizen regarding the <br />sidewalk being torn up again in front of his home, saying it was recently replaced. That <br />particular sidewalk is too narrow to meet ADA specifications and needed to be widened. It was <br />able to be brought up to specs using the Community Crossings Grant. <br />Interim Chief Salary Discussion — Councilman Cook stated it had been brought to his attention <br />and he did not realize that Brock Chipman was not receiving Chief pay while acting as the <br />Interim Chief. Officer Chipman is still receiving his patrolman pay and lost his shift differential <br />for moving from second shift to day shift. Councilman Cook stated he feels Officer Chipman <br />should be compensated for stepping up and making sacrifices for the Town during its time of <br />
