<br />STREET PRIVATE: A right-of-way or easement for the public <br />use for vehicular and pedestrian traffic which is owned and <br />maintained by a private person or entity and not by a <br />90vernmental body. Use of a private street may be limited by <br />lts owner or owners. Private streets may serve residential <br />or nonresidential properties. <br /> <br />STREET PUBLIC: A right-of-way dedicated for the public use <br />for vehicular and pedestrian traffic to be owned and <br />maintained by the governmental body having jurisdiction. <br />other ancillary uses such as drainage and/or utility <br />facilities may also be included within public right-of-way. <br /> <br />STRUCTURAL ALTERATION: Any change in the su~porting members <br />of a building, such as bearing walls or partltions, columns, <br />beams or girders, or any substantial change in the exterior <br />walls, roof, electrical systems, plumbing systems or <br />mechanical equipment. <br /> <br />STRUCTURE: Anything constructed or erected which requires <br />location on the ground or attachment to something having a <br />location on the ground. <br /> <br />SUBDIVISION: A division of any parcel of land into two or <br />more parcels, sites, or lots, anyone of which is less than <br />20 acres in area for the purpose of transfer of ownership or <br />building development; or <br /> <br />The improvement of one or more parcels of land not under one <br />ownership for residential, commercial or industrial <br />structures or groups of structures involving the subdivision <br />and allocation of land as streets or other open spaces for <br />common use by owners, occupants or lease holders or as <br />easements for the extension and maintenance of public sewer, <br />water, storm drainage or other public utilities and <br />facilities. <br /> <br />Exemption from platting requirements: For the ~urposes of <br />these regulations, the following are exempt as lmplying sub- <br />division, and thereby exempt from the platting requlrements <br />of this ordinance: <br /> <br />1. An allocation of land in the settlement of an <br />estate of a descendant or a court decree for the <br />distribution of property. <br /> <br />2. The unwilling sale of land as a result of legal <br />condemnations as defined and allowed in the Indiana <br />State Law. <br /> <br />3. widening of existing streets to conform to the <br />Comprehensive plan. <br /> <br />13 <br />
