<br />· <br /> <br />'-- <br /> <br />Mr. Jeff Dobbs addressed the Commission in regard to his <br />concern in regard to run off from this proposed subdivision <br />in the existing pond which is used for swimming and fishing. <br />Mr. Dobbs also is concerned about septic systems in this <br />proposed subdivision. Mr. Dobbs also questioned the <br />elimination of trees in this area due to this proposed sub- <br />division. <br /> <br />Motion was made by Bill Abbott to give preliminary plat <br />approval to the petition filed on behalf of Frank H. Lowry <br />for a 44 lot subdivision on the parcel of land located on <br />Keller Hill Road being part of the E/2 of the SE/4 of Section <br />33, T14N RIE containing 53.748 acres, more or less. This <br />approval is granted contingent on the following stipulations: <br />that utility easements be stipulated between lots on the west <br />side of the subdivision so if the two adjoining property <br />owners to the west need the use of Hill Water it will be <br />accessible to them; review of construction permits; <br />dedication of public right of way; water system being shown <br />on final plat; the requirements for sidewalks is waived and <br />waive the width to depth ratio on lots 19, 27, 28, 29, 30 and <br />31. John Ehrhart second. Motion carried unanimously. <br /> <br />Motion was made by Bill Abbott, second by Vern Kimmel to <br />waive the 10:30 p.m. Plan Commission closing time and <br />continue with t.he agenda. Motion carried unanimously. <br /> <br />'-' <br /> <br />Mr. Earl Waymeir, owner of the parcel of land located at <br />State Road 144 and State Road 67 on the north west corner, <br />appeared before the Plan Commission requesting a <br />determination of zoning for a flea market. Mr. Waymeir asked <br />the Plan Commission if a flea market cOllld operate in a B-2 <br />classi- <br />fication by special exception. <br /> <br />Motion was made by Bill Abbott, second by Charles <br />McGuire that the Plan Commission find that a flea market <br />located in B-2 by special exception does not affect the <br />master land use plan of the Town of Mooresville. <br />Motion carried unanimously. <br /> <br />Motion was made by Bill Abbott, second by John Ehrhart <br />to give final plat approval for Trinity Estates Subdivision <br />contingent on necessary bonding for infrastructure, payment <br />of the remainder of the sewer availability fee, and the <br />approval of the hydrant placement by Mooresville Fire Chief <br />Darrell Brown. Motion carried unanimously. <br /> <br />Motion was made by Charles McGuire, second by Vern <br />Kimmel to give final plat approval for Rooker Run, Section <br />III, contingent on necessary bonding for infrastructure and <br /> <br />'- <br /> <br />7 <br />
