<br />have been due to the need for the commercial use to be established <br />to help support the financing on the balance of the construction. <br />- <br />Mark Mathis, of 133 Northeast Street, stated that he knew Mr. <br />Raymond and felt that he would do everything that he had stated he <br /> <br />'- <br /> <br />~ <br /> <br />would do. Bill Abbott then questioned the Board's Attorney as to <br />what issues were currently before the Board. The Attorney advised <br />that the rezoning issues were initially before the Board and plat <br />approval would be looked at after this portion had been concluded. <br />Floyd Duncan then spoke and stated that he wanted to keep the area <br />residential. Signe Nicholson spoke on behalf of her husband, Phil <br />Nicholson, one of the property owners at 203 North Indiana Street. <br />Mr. Nicholson's concerns were based upon drainage problems that <br />would be created with any type of intensive land use placed <br />downstream from their property. Harold Nance of 117 East Hadley <br />Street then stated he wanted the property to stay as a residential <br />and further stated that drainage is a problem. Elby Miller of <br />Washington Street had questions concerning noise from the music <br />studio. Mr. House stated that the recording studio would be <br />soundproof out of necessity. In particular, to have a good <br /> <br /> <br />recording studio you needed to keep all outside sounds from coming <br /> <br /> <br />in, which, likewise, keeps inside sounds from going out. <br /> <br /> <br />The Board then proceeded with a discussion of the proposed <br /> <br /> <br />rezoning. Signe Nicholson questioned the Board's Attorney <br /> <br /> <br />concerning the restrictions referred to. Attorney Currens advised <br /> <br /> <br />that his interpretation of Indiana Code 36-7-4-613 required the <br /> <br /> <br />rezoning to be filed as a planned unit development before any <br /> <br /> <br />types of restrictions could be placed upon the rezoning.
