gave a quick explanation of the law and the reason for his

interpretation. Bill Abbott then moved to table this matter until

it had been amended by refiling as a planned unit development.

Steve Edwards seconded the motion and further stated that he felt

this ground needed to be used and that this type of project has a

lot of potential. The Board unanimously voted to table this until

the matter was refiled as a planned unit development.

The next item to come before the Board was the petition for

rezoning filed by Roger Caperton, Donald Stafford, and Steve

Buchanan, along with a request for preliminary plat approval. The

petitioners were requesting a rezoning of 38 acres from AR to GB,

20 acres from AR to B-Multi-family, and 39.5 acres from AR to A-

Residential. The property is all located east of Highway 67 at

Bridge Street. The petitioners were present in person and by

counsel, Mark Peden. Also present was Jeff Banning from Lewis
'---

Engineering. Attorney Peden presented the initial drawings and

locations of each of the proposed uses. He then turned the

meeting over to Roger Caperton. Mr. Caperton explained the intent

of the petitioners to extend Bridge Street beyond State Road 67

and on into the respective General Business, Multi-family, and A-

Residential uses. He advised that the uses would each be buffered

from each other and would have nice entry ways leading into each

of the uses. The Multi-family use would have a clubhouse, pool,

and tennis courts. Mr. Caperton advised that they also own some

property further east, but it was not their intent to have any of

this rezoned at this time. He also advised that the surface water

would be dealt with and that Lewis Engineering had already looked

'---

-4-
