<br />error on the first page of the preliminary plat which indicated twenty-six <br /> <br />lots. He advised that the proposal was only for sixteen lots. He advised <br /> <br />that this property was in the buffer zone and was not subject to connection <br /> <br />to the town sewer or water. He advised that they would like approval prior <br /> <br />to summer to begin construction. <br /> <br />Mr. Lawson further advised that before preliminary approval he would <br /> <br />need to obtain a letter from the county highway department that the streets <br /> <br />met the minimum standards and also Board of Health approval regarding the <br /> <br />septic systems to be installed. He indicated that preliminary correspondence <br /> <br />with the county indicates that they may not accept the street as a dedicated <br /> <br />street. He questioned whether if the county will not accept the street so <br /> <br />that it remains a private street, will they still be required to obtain the <br /> <br />performance bond drawn in favor of the commissioners. <br /> <br />'- <br /> <br />Attorney Ksenak advised that the town stood potentially liable to the <br /> <br />purchasers of the property if they did not enforce the requirement that a <br /> <br />performance bond be obtained. Bill Abbott also indicated the need to protect <br /> <br />the purchasers and this was the purpose of the bond. <br /> <br />Bill Abbott then questioned whether the streets in the subdivision <br /> <br />needed to meet Morgan County standards or town standards. Dave directed the <br /> <br />Board's attention to the town ordinance which specifically indicates that <br /> <br />the streets in the buffer zone were to be covered by the county orldinance. <br /> <br />The Board then went through the requirements of the subdivision control <br /> <br />ordinance and determined the following deficiencies: <br /> <br />(I) no location map <br /> <br />(2) no source of title to the land as shown by the books of the <br /> <br />Morgan County Recorder <br /> <br />(3) no indication of the corner-cuts on Lots II and 26 <br /> <br />(4) the Board advised that a variance would be required on the depth <br />- 6 - <br />
