<br />-8- <br /> <br />necessary legal action against Mr. Turner for maintaining a multiple- <br />family occupancy in a general business district. The motion was <br />seconded by Dave Barry and unanimously carried. <br />The Board then asked Attorney Ksenak whether it would be within <br />their jurisdiction to request the Mooresville Police to cite Mr. <br />Turner for any and all violations which could be found. Attorney <br />Ksenak advised that he felt that their proposal went beyond the <br />province of their jurisdiction and felt that at most as a citizens <br />group they could make the request but not as the Planning Commission. <br />The Board then as a group of interested citizens asked the Mooresville <br />Police Department to investigate any alleged violations at the Doug <br />Turner property at 39 West Main Street in Mooresville, Indiana, <br />specifically looking to the trash and abandoned car ordinances and <br />to make whatever citations can be determined exist. The motion <br />seconded by Dave Barry and unanmiously carried. The Board then asked <br />the attorney to place as an item on the next agenda a report from <br />the Board Attorney to the Planning Commission as to their actual <br />authority regarding the enforcement of the Mooresville zoning <br />ordinance. <br /> <br /> <br />George Ditton responded to the request and advised that his <br /> <br /> <br />Department would enforce any violations to the fullest extent of <br /> <br /> <br />the law. <br /> <br /> <br />The next item on the agenda was the Raymond Reed violation. <br /> <br /> <br />Attorney Roscoe Stovall advised that there'd been allegations <br /> <br /> <br />that Mr. Reed was using a single-family dwelling as rental <br /> <br /> <br />property. He advised that based upon the Board's concern that one <br /> <br /> <br />tenant has moved out and he further indicated that Mr. Reed was well <br /> <br />~ <br />
