Present representing the petitioner was David Best. Mr. Best <br /> <br />indicated that Cloverleaf had made all additions to the preliminary plat as <br /> <br />required by the ordinance and as noted by the commission at its last meeting. <br /> <br />He further indicated that that amended preliminary plat was submitted to the <br /> <br />Board approximately 10 to 14 days prior to the meeting. The Board compared the <br /> <br />preliminary plat against the list established by the Board at the last meeting <br /> <br />and Bill Ahbott iodicated that on the report from the Department of Natural <br /> <br />Resources it showed that the 100 year flood plain was located at an elevatioo <br /> <br />of 663 feet. The Board asked for a copy of the Department of Natural Resources <br /> <br />approval to be submitted to the Board Attorney. Attorney Ksenak advised that <br /> <br />the legal notice was not published until May 14, 1986 which was only 8 days prior <br /> <br />to the meeting, in violation of the zoning ordinance~ Finding no remonstrators <br /> <br />present) Dave Barry moved to waive the 2 days notice reqllirement and to proceed <br /> <br />with final plat approval. The motion ,,,as seconded by Wendell Thaler and unanimously <br /> <br />carried. <br /> <br />The Board then approved the preliminary plat and moved on to the final <br /> <br />plat requi rements. The blueprints for the subdivisi on revealed a 12 foot 'Jtility <br /> <br />easement for a sewer line. Inspector Joe Beikman indicated that they would need <br /> <br />at least a 15 to 20 foot minimum if re~airs were necessary. Mr. Best indicated <br /> <br />that it was the intent of the corporation to dedicate that easement to the Town <br /> <br />and would provide for a 20 foot easement. <br /> <br />Inspector Beikman then indicated that with regards to the streets, that <br /> <br />the plat should be changed to meet the base requirements for feeder streets <br /> <br />rather than residential. <br /> <br />The Board waived the scale requirements of 1 to 50. Dave Barry moved <br /> <br />to approve the final plat subject to the utility easement being changed from 12 <br />
