In

----

particular he felt this would allow Mr. Graybill to either get the work accomplished

and have a meeting with Mr. Beikman regarding what needed to be done before the

Board makes any decision under the ordinance. Steve Edwards agreed with this and

stated that the next meeting a hearing should be held. Tilford Bailey advised that

Mr. Graybill should speak with the Building Inspector in order to get these matters

taken care of before any hearing was held. Bud Swisher and Vern Kimmel agreed.

The Board then unanimously approved the motion for continuance by Mr. Graybill and

set this matter for the public hearing under the unsafe building notice of order

previously filed and set the hearing for October 24, 1985 at 7:30 p.m. giving

verbal notice to Mr. Graybill at the open meeting. Attorney Currens then explained

to Mr. Graybill and the Board the legal ramifications involved including penalties

and potential actions the Board could take.

The Board then proceeded with the Mitchell Denney Subdivision problems

'-' concerning the intersection into the subdivision. The Board's Attorney advised

that Mr. Denney had contacted him stating that he felt he was in compliance.

William Abbott stated that all the work had not been completed and Mr. Beikman

agreed. After a discussion the Board decided that the easiest way to deal with

the problem would be to have Mr. Denney come to the next meeting and have the

Board itemize the work which must be completed.

The next item on the agenda was the Building Inspector's report and

Building Inspector Beikman advised that he had issued 9 permits and completed

14 inspections.

Fire Chief Bruner then spoke to the Board regarding the smoke detector

ordinance which he had given to the Board some months ago. He advised that he

wanted the Board to consider this sometime in the future and would hope that

the Board would recommend to the Town Board an ordinance along these lines. Bud

---

Swisher had a question regarding the retroactivity of any such ordinance. The

-3-
