<br />Mr. Holloway presented a request for a revision to the Bridge Street plat located behind <br />Casey's General Store by adding a lot #3. The size of the lot is .448 acres in the <br />northwest comer and zoned B-3. Commissioner Bryant asked why the need for Lot #3. <br />Mr. Holloway said Lot #3 had been sold. Commissioner Bruner said he had a question <br />that had to do with lots 1 and 2 and asked if a water main and hydrant could be extended <br />back to the property line oflot 2. Mr. Holloway said this was very possible as Mr. <br />Hopkins has backhoes and other equipment to accomplish this extension. He could not <br />commit to this because he hadn't talked to Mr. Hopkins. <br /> <br />From the audience, Greg Johnson, President of Mooresville Girls Softball League, spoke <br />to the commission say he was opposed to the approval of the lots due to drainage <br />problems. Mr. Hopkins had made a retaining wall around the softball league parking lot <br />and down their driveway entrance and this is going to be a problem for them. Carl Hart, <br />Vice-President of Mooresville Girls Softball League said he had contacted DNR and a <br />permit had been filed but with restrictions that the retaining wall not create a flood <br />condition for surrounding properties and that it not be within fifty feet of the creek way <br />that runs down thru there. There are parts of that wall that are within fifty feet. DNR is <br />investigating and it could take up to thirty days for them to investigate and get back to the <br />league with their findings. There was water standing in the driveway today that normally <br />would not be, so Mr. Hopkins has increased the flooding capability as well as the <br />property belonging to Perry Acoustics. Mr. Johnson said they have a mortgage and six <br />hundred girls that enjoy playing there, if this flooding continues we are really in trouble. <br />He asked that the commission keep a close surveillance with this project because they <br />cannot take the water. This is a six-foot tall dirt levy. Mr. Holloway said a drainage plan <br />has to be filed. Attorney Currens stated the issue was not on this tract of land and issue <br />two is the commission has no control or enforcement on this issue. The DNR makes the <br />rules on this and do the enforcement. Mr. Johnson said he wanted to voice his <br />opposition. Attorney Currens said that actually this plan had already been approved; this <br />was just a modification of the plan before the commission tonight. Mr. Holloway has <br />certified the drainage. Mr. Holloway said there is a large retention basin on Lot 2. A <br />motion was made by Commissioner Crouch with a second by Commissioner Bruner to <br />approve revision of Hopkins Bridge Street minor plat, lot 3. Motion carried 7-1 with <br />Commissioner Williamson opposed. <br /> <br />Next, Attorney Currens told the commission he had before them the definition of a <br />Nightclub to blend in with the Comprehensive Plan and to recommend to the Mooresville <br />Town Council to add this definition to the Comprehensive Plan. The definition reads: A <br />club, both private and public, that is 2500 square feet or greater, provides entertainment <br />and mayor may not serve food, drinks, or beverages. <br /> <br />N01E: Nightclub shall be allowed in B-3 District by Special Exception only. <br /> <br />There were no questions from the commission or from the floor. A motion was made by <br />Councilman Bryant with a second from Councilman Ehrhart to make the <br />recommendation to add this definition to the Comprehensive Plan. Motion carried 8-0. <br />
